Bickel <br />Dated this 16th day of November, <br />1970." <br />RESOLUTION NO. 11-16-70 (a) ADOPTED <br />- FOR <br />CONSTRUCTION OF STORM WATER <br />RETENTION BASINS "A" AND "K" <br />Upon motion made, seconded and unanimously carried, the following resolution <br />was adopted; <br />"RESOLUTION NO. 11-16-70 (a) <br />A RESOLUTION AUTHORIZING THE ACQUISITION OF <br />LAND FOR CONSTRUCTION OF STORM WATER RE- <br />TENTION BASINS. <br />WHEREAS, the City of South Bend has been mandated by <br />the State of Indiana to separate storm water drainage from <br />its sanitary sewer system by not later than the year 1977; <br />and <br />WHEREAS, the Board of Public Works and Safety has em- <br />ployed consultants to make surveys and to determine the <br />most feasible method of accomplishing this end; and <br />WHEREAS, the said consultants have recommended the <br />construction of storm water retention basins in and near <br />certain areas of the City as the most reasible and economical <br />method of achieving separation of storm water and sanitary <br />drainage; and <br />WHEREAS, the Common Council of the City of South Bend <br />has appropriated funds for the construction of the first four such <br />storm water retention basins; and <br />WHEREAS, certain real estate must be acquired in order <br />to construct such basins; <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC <br />WORKS AND SAFETY OF THE CITY OF SOUTH BEND, IND IANA: <br />1. That the construction of storm water retention <br />basins designated "A" and "K" and their related sewer and <br />drainage systems is necessary for the health, welfare and <br />safety of the citizens and taxpayers of the City of South <br />Bend and such basins, upon completion, would be of public <br />use and benefit. <br />2. That in order to construct same it is necessary <br />to acquire, by purchase, gift or condemnation, the follow- <br />ing described real estate: <br />(a) For Lagoon "A": Lots 30, 31, 40, 41, 42, <br />45, 46, 47, 48 as shown in Fairview Second Addition, St. <br />Joseph County, South Bend, Indiana; and <br />(b) Lots 39 through 51, inclusive, Lots 53 <br />through 65, inclusive, and Lots 101 through 109, inclusive, <br />as shown in Belmont Addition, Portage Township, St. Joseph <br />County, Indiana, for Lagoon "K." <br />
