10/26/70 <br />ASSESSMENT ROLL FILED - VACATION RESOLUTION NO. 3329 - MIDWEST TURNKEY <br />BUILDERS <br />Lloyd S. Taylor, City Engineer, files assessment roll, in Vacation Resolution <br />No. 3329, for the vacation of: <br />Frances Street, from the north line of Miner Street extend- <br />ing north 105 feet to the south right of way lineā¢of a 12 <br />foot alley as shown on the recorded plat of Lederer and <br />Longley's Subdivision of Out Lot numbered 1 in Samuel L. <br />Cottrell's First Addition to the town of Lowell, now a part <br />of the city of South Bend. This portion of the street was <br />formerly Lots 35 and 36 of said Addition., <br />The Board sets November 23, 1970, as the date for receiving remonstrances <br />and hearing all persons interested in or affected by such vacation. And <br />the Clerk is directed to give notice of such hearing by publication in the <br />South Bend Tribune and the Tri County News on October 30, November 6 and <br />November 11, 1970. <br />The following property may be injuriously or beneficially affected by such <br />vacation: <br />Lots numbered 1 through 48 in Lederer and Longley's <br />Subdivision of Out Lot numbered I in Samuel L. Cottrell's <br />First Addition to the town of Lowell, now a part of the <br />city of South Bend. Lots numbered 35 and 36 not platted at <br />this time. <br />Total net benefits $00.00 <br />Total net damages $00.00 <br />AREA PLAN COMMISSION RECOMMENDATION <br />ADOPTION OF VACATION RESOLUTION NO. 3332, 1970 <br />FOR THE VACATION OF 36TH STREET AND -THREE ALLEYS (LAGOON "K") <br />Area Plan Commission recommends favorably for the vacation of: <br />Thirty-sixth Street, from the south line of Lots 40 and 65 <br />north to the south line of Washington Street. Also, the <br />north -south alley lying between 35th Street and 36th Street <br />from the south line of Lots 101 and 62 north to the south <br />line of Washington Street. Also, the east -west alley running <br />from 35th to 36th Street and lying between Lots/101 and 102 <br />and Lots 61 and 62. Also, the east -west alley running from <br />36th Street east to the first north -south alley and lying <br />between Lots 43 and 44. All in Belmont Addition to the <br />city of South Bend. <br />And the Board, upon motion made, seconded and unanimously carried, adopts <br />the following Resolution: <br />"RESOLUTION NO. 3332, 1970 <br />"RESOLVED BY THE BOARD OF PUBLIC WORKS AND SAFETY OF THE <br />CITY OF SOUTH BEND, INDIANA, That it is desirable to vacate the <br />following <br />36th Street, from the -south line of Lots 40 and 65 north <br />to the south line of Washington Street. <br />Also, the north -south alley lying between 35th and 36th <br />Streets from the south line of Lots 101 and 62 north to <br />the south line of Washington Street. <br />Also, the east -west alley running from 35th to 36th Street <br />and lying between Lots 101 and 102 and Lots 61 and 62. <br />Also, the east -west alley running from 36th Street east to <br />the first north -south alley and lying between Lots 43 and <br />44. <br />All in Belmont Addition to the city of South Bend, Indiana. <br />Reserving the rights and easements of all utilities and the <br />municipal city of South Bend, Indiana, to construct and maintain any <br />facilities, including, but not limited, to the following: electric, <br />
