10/5/70 <br />HEARING ON VACATION RESOLUTION NO. 3328 - DR. ARMAND J. RIGAUX CONT. FROM <br />9/2 /70 <br />The matter of the hearing on Vacation Resolution No. 3328, for the vacation <br />of a portion of the north -south alley between Penn Central right of way and <br />Otsego Avenue from the south right of way line of Angela Boulevard running <br />126 feet, upon motion made, seconded and carried, was further continued to <br />October 19, 1970. <br />HEARING ON VACATION RESOLUTION NO. 3329 - MIDWEST TURNKEY BUILDERS INC. <br />(cont. from 9/28/70) <br />Having been continued from September 28, 1970, hearing was resumed on <br />Resolution No. 3329, being for the vacation of; <br />Frances Street from the north line of Miner Street extend- <br />ing north 105 feet to the south right of way line of a 12 <br />foot alley as shown on the recorded plat of Lederer and <br />Longley's Subdivision of Out Lot numbered 1 in Samuel L. <br />Cottrell's First Addition to the town of Lowell, now a part <br />of the�city of South Bend. This portion of the street was <br />formerly Lots 35 and 36 of said Addition. <br />Robert L. Miller, attorney, appeared on behalf of the petitioner. Attorney <br />F. Jay Nimtz appeared on behalf of 47 persons opposing the vacation. <br />Approximately 15 other interested persons appeared before the Board. <br />Mr. Miller stated that after, further study the petitioner offers two plans <br />for the vacation --one the same as previously offered except for widening of <br />the area to 18 feet; and the other providing for the vacation to the east, <br />which still would not line up with the vacant lot as had been hoped. A <br />third alternative was suggested of vacating a.portion on the east side and <br />a portion on the west side of Frances Street. <br />Mr. Nimtz, Mrs. Ethel Meservey, Mrs. Hariett Clawson and Mrs. Violet Johnson <br />objected to any vacation as increasing traffic problems in the neighborhood. <br />Having heard all who wished to speak, the .motion was made, seconded and <br />carried to continue the matter until October 19, 1970, to afford the Board <br />members the opportunity to inspect the site proposed to be vacated. <br />IMPROVEMENT RESOLUTION NO. 3319, 1970 - GERTRUDE STREET (RESCINDED) <br />For the improvement of Gertrude Street, from Ewing Avenue to Prairie Avenue, <br />by widening and paving with new curbs. <br />A written remonstrance against said improvement bearing the signatures of <br />51% or more of the resident property owners on said street who may be liable <br />for assessment for the said improvei,ient having been filed with the Board <br />within the 10 day period following the hearing on said Improvement Resolution, <br />upon motion made, seconded and unanimously carried, Improvement Resolution <br />No. 3319, 1970, adopted June 8, 1970, and confirmed June 30, 1970, is in all <br />things rescinded and the improvement ordered not made. <br />FINAL CONFIRMATION OF IMPROVEMENT RESOLUTION NO. 3323 - HUMBOLDT STREET <br />For the improvement of Humboldt Street, from Elmer to Huey, by constructing <br />a Class C pavement with curbs. <br />No written remonstrance bearing the signature of 51% or more of the resident <br />property owners on said street to be improved having been filed within the <br />10 day period following the hearing on said improvement Resolution, upon <br />motion made, seconded and unanimously carried, said Improvement Resolution <br />No. 3323, 1970, adopted on August 17, 197.0, and confirmed on September 8, <br />1970, is in all things finally confirmed and the improvement hereby ordered <br />made. <br />1 <br />1 <br />1 <br />
