9/14/70 <br />and explained the purpose of the vacation. <br />Mrs. Robert Jernigan, 226 S. Notre Dame Avenue, South Bend, Indiana, appeared <br />in response to notice received. It was determined that her property would <br />in no way be affected by the vacation. <br />No remonstrators having appeared and no written remonstrances having been re- <br />ceived and having heard all who wished to speak, upon motion made, seconded <br />and carried, the Resolution adopted on August 31, 1970 was in all things <br />approved and confirmed and the vacation granted. <br />And the City Engineer was directed to prepare an assessment roll covering <br />the assessment of benefits and the award of damages to the surrounding <br />properties. <br />HEARING ON VACATION RESOLUTION NO. 3328 - DR. ARMAND RIGAUX <br />This being the date set, hearing was held on Vacation Resolution No. 3328, <br />being for the vacation of: <br />A portion of the north -south alley between Penn <br />Central right of way and Otsego Avenue from the <br />south right of way line of Angela Boulevard <br />running south 126 feet. <br />The Clerk tendered proofs of publication of notice in the South Bend Tribune <br />and the Tri County News on September 4 and September 11, 1970, which were <br />read and found to be sufficient. <br />Mr. and Mrs. D. J. Goolsby, 1308 Otsego Street, South Bend, Indiana, appeared <br />before the Board and stated they are in favor of the vacation providing their <br />garbage and trash can be picked up. <br />No one further appeared either for or against the vacation. <br />Since the petitioner was not present and several questions were raised, it <br />was moved, seconded and carried that the hearing be continued until September <br />28, 1970. <br />ASSESSMENT ROLL FILED - IMPROVEMENT RESOLUTION NO. 3311 - ALLEY BETWEEN <br />INGLEWOOD AND HOLLYWOOD <br />Lloyd S. Taylor, City Engineer, files assessment roll, with the names of the <br />owners and a description of the property.: subject to be assessed, with the <br />amount of the prima facie assessment in the total sum of $10,076.51, in the <br />matter of the improvement of the alley between Inglewood Place and Hollywood <br />Place; from Woodlawn Avenue to Oakwood Avenue, by constructing a Class C, <br />Type I concrete pavement. <br />Upon motion made seconded and unanimously carried, the Board adopts a <br />resolution accepting said assessment roll and sets 9:30 A.M. on October l9; <br />1970, Room 1308 County City Building, as the time and place for receiving <br />remonstrances against the amounts assessed on said roll and will at such time <br />determine whether such lots or tracts of land have been or will be benefited <br />b y such improvement to the amounts named. <br />And the Clerk is directed to•give notice of such hearing by publication in the <br />South Bend Tribune and the Tri County News on 990MMeiEUBX AX September 25, <br />1970, and October 2, 1970. <br />REQUEST TO ADVERTISE FOR VEHICLES FOR ENGINEERING DEPARTMENT <br />Upon motion made, seconded and unanimously carried, the Board approved the <br />request of the City Engineer for permission to advertise for two vehicles <br />for the Engineering Department. September 28, 1970, was set as the time for <br />receiving bids, and the Clerk was directed to give notice by publication in <br />the South Bend Tribune and the Tri County News on September 18 and September <br />25, 1970. <br />
