<br />Lot numbered 1 in Samuel L. Cottrell's First Addition
<br />to the town of Lowell, now a part of the city of South
<br />Bend. This portion of the street was formerly Lots 35
<br />and 36 of said Addition.
<br />Reserving the rights and easements of all utilities and the
<br />municipal city of South Bend, Indiana, to construct and maintain any
<br />facilities, including, but not limited to, the following: electric,
<br />telephone, gas, water, sewer, surface water control structures and
<br />ditches, within the vacated right of way, unless such rights are re-
<br />leased by the individual utilities.
<br />The following property may be injuriously or beneficially
<br />affected by such vacation:
<br />Lots numbered 1 through 48 in Lederer and Longley's
<br />Subdivision of Out Lot numbered one in Samuel_L.
<br />Cottrell's First Addition to the town of Lowell, now a
<br />part of the city of South Bend (Lots numbered 35 and 36
<br />not platted at this time).
<br />Notice of this resolution shall be published on the llth
<br />day of September, 1970 and the 18th day of September, 1970, in the
<br />South Bend Tribune and in the Tri County News.
<br />This Board, at its office, on the 21st day of September, 1970,
<br />at 9:30 o'clock, A.M., will hear and receive remonstrances from all
<br />persons interested in or affected by these proceedings.

<br />Street north to the alley, signed by Dorothy Ann Benz, 919 Miner Street,
<br />South Bend, Indiana and 46 others was filed with the Board by attorney F.
<br />Jay Nimtz, 511 W. Colfax Avenue, South Bend, Indiana.
<br />PETITION TO PAVE ALLEY BETWEEN McKINLEY AND LASALLE
<br />A petition to pave the east -west alley between LaSalle and McKinley, from
<br />Twyckenham to Esther Street, was filed with the Board bar -Maurice Goldman,
<br />1606 McKinley Street, South Bend, Indiana, and 23 others. Upon motion made,
<br />seconded and carried, the petition was referred to the City Engineer for
<br />study and recommendation to the Board.
<br />TOPJCS PROGRAM
<br />The motion was made, seconded and unanimously carried that the City of South
<br />Bend, through its Board of Public Works and Safety, subject to the availability
<br />of3funds, enter into an agreement with Clyde E. Williams and Associates,'lnc.,
<br />as consulting engineers in connection with a TOPICS program.
<br />IN -KIND RENT VOUCHERS - A.C.T.I.O.N., Inc.
<br />In -kind rent vouchers for September, 1970, of the value of $169.62 for Fire
<br />Station #5 and of the value of $200.00 for Fire Station #7 from A.C.T.I.O.N.,
<br />Inc. were ordered filed.
