<br />Upon motion made, seconded and carried, the matter of awarding contract for

<br />PETITION TO VACATE FRANCES STREET - MIDWEST TURNKEY BUILDERS, INC.
<br />Midwest Turnkey Builders, Inc., Suite #1, Peoples State Bank Building, St.
<br />Joseph, Michigan, 49085, by its attorney, Robert L. Miller, 112 Lafayette
<br />Building, South Bend, Indiana, files petition to vacate a portion of Frances
<br />Street, extending north 105 feet to a 12 foot alley as shown on the recorded
<br />plat of Lederer and Longley's Subdivision of Out Lot One in Samuel L.,
<br />Cottrell's First Addition to the town of Lowell, now a part of the city of
<br />South Bend, formerly Lots 35 and 36 of said Addition, and deposits $65.00
<br />for costs.
<br />Upon motion made, seconded and carried, the petition .was referred to the City
<br />Engineer for map of the area, and then to be referred to the Area Plan
<br />Commission for study and recommendation to the Board.
<br />FINAL CONFIRMATION OF IMPROVEMENT RESOLUTION N0._3318 - E. WASHINGTON AVENUE
<br />Remonstrances filed against the improvement of E. Washington Avenue, from Green -
<br />lawn to Ironwood, by constructing a Class C pavement with curbs and curb repair,
<br />within the 10 day period following the hearing on June 30, 1970, not being
<br />equal to 51% or more of the resident property owners on said street sought to
<br />be improved, upon motion made, seconded and carried, Improvement Resolution
<br />No. 3318, adopted June 8, 1970, and first confirmed June 30, 1970, is hereby
<br />finally confirmed and the improvement ordered made.
<br />MPROVEMENT RESOLUTION NO. 3320 RESCINDED - ALLEY BETWEEN 25TH AND 26TH STREETS .
<br />Written remonstrances against the improvement of the alley between 25th.and 26th
<br />Streets, from Pleasant Street for approximately 215 feet then west to 25th Street
<br />by constructing a Class C., Type 1, concrete pavement, bearing signatures of 51%
<br />or more of the resident property owners on said street sought to be improved
<br />who may be liable for assessment for said improvement having been filed within
<br />the 10 day period following the hearing June 30, 1970, upon motion made,
<br />seconded and carried, Improvement Resolution No. 3320, adopted June 8, 1970,
<br />and first confirmed June 30, 1970, is hereby in all things rescinded and the
<br />improvement ordered not made.
<br />IMPROVEMENT RESOLUTION NO. 3321, 1970 ADOPTED - BEALE STREET SEWER
<br />Upon motion made, seconded and carried the Board adopts Resolution No. 3321,
<br />1970, for the improvement of Beale Street, from Cushing Street to Riverside,
<br />by constructing a local sewer, in accordance with the plans and specifications
<br />approved by the Board May 18, 19701.
<br />August 11, 1970, at 7:30 P.M., in Room 1308 County City Building, South Bend,
<br />Indiana, is set as the time for receiving remonstrances and when all persons
<br />whose property might be affected by such improvement may appear and be heard,
<br />and at which time the Board will decide whether the benefits accruing to
<br />abutting or adjacent property will be equal to or exceed the.estimated cost
<br />of said improvement.
<br />And the Clerk of the Board is directed to give notice of such hearing by
<br />publication in the South Bend Tribune and the Tri County News on July 24 and
<br />July 31, 1970.
<br />COMPLAINT RE: FACTORY AT 720 S. CARROLL STREET - ENID SPOHNHOLZ
<br />Building Commissioner Forrest West reports to the Board this his investigation
<br />in reference to the complaint of Miss Enid Spohnholz filed with the Board on
<br />June 15, 1970, discloses that the factory at 720-724 S. Carroll Street at the
<br />times investigation was made was operating in conformance with the "light
<br />industrial" zoning law. The Clerk is directed to so notify Miss Spohnholz.
