7/6/70 <br />This being the date set, hearing was held on the assessment roll in Vacation <br />Resolution No. 3314, being for the vacation of: <br />Part of Napier Street, located immediately south of and ad- <br />jacent to Lot 32 as shown in John F. Kirby's Subdivision of <br />Bank Out Lot 83; and a part of Cherry Street, beginning at <br />the northwest corner of Lot 37 of John F. Kirby's Subdivision <br />of Bank Out Lot 83; thence. north to the northwest corner of <br />Lot 29; thence west to the west line of Cherry Street; thence <br />south along the west line of Cherry Street to a point directly <br />west of the northwest corner of Lot 37; thence east to the <br />point of beginning. <br />Proofs of publication of notice in the South Bend Tribune and the Tri County <br />News on June 12, June 19 and June 26, 1970, were read and found to be <br />sufficient. No remonstrators having appeared and no written remonstrances <br />having been filed, upon motion made, seconded and unanimously carried, the <br />assessment roll was adopted as presented and the Vacation Resolution in all <br />things .confirmed and ratified and the proceedings concluded. <br />X9 HEARING ON VACATION RESOLUTION NO. 3317 - MILL RACE, INC. (30 FT. EASEMENT) <br />Hearing on Vacation Resolution No. 3317 for the vacation of an easement <br />described as that part of the west leg of the East Race which is located <br />northerly of a line parallel to and 30 feet southerly of the southerly line <br />of Hydraulic Avenue and located westerly of the west line of the East Race, <br />which said west leg of the East Race is the -Race located on the southeasterly <br />and east sides of Hydraulic Avenue in Section 1 and in Section 12, Township <br />37 north, Range 2 east, in the city of South Bend, Indiana, having been <br />continued from June 29, lg70, and the drainage problem having been now <br />resolved, upon motion made, seconded and unanimously carried, the adoption of <br />Vacation Resolution No. 3317 on May 25, 1970, is ratified and confirmed. <br />And the City/Engineer,is directed to prepare an assessment roll showing the assess- <br />ment of benefits and damages to the surrounding property. <br />Attorney Bruce Stewart attended the meeting. <br />ASSESSMENT ROLL FILED - VACATION RESOLUTION NO. 3308 - DONALD F. And the Clerk is directed to give notice of such hearing by <br />publication in the South Bend Tribune and the Tri County News on July 10, <br />July 17 and July 24, 1970. <br />PETITION FILED - TO VACATE IVY ROAD, SOUTH BEND AVENUE TO EDISON ROAD - <br />NOTRE DAME UNIVERSITY AND STANLEY PIETZAK <br />Attorney Irving Smith, on behalf of the University of Notre Dame and Stanley <br />and Patricia Pietzak, 302 Ostemo Place, South Bend, Indiana, filed a petition <br />to vacate Ivy Road, from South Bend Avenue to Edison Road. Upon motion made, <br />seconded and carried, the petition was referred to the City Engineer for <br />drawing of the area and referrat to Area Plan Commission for study and <br />recommendation to the Board. <br />
