<br />VACATION RESOLUTION NO. 3315 - BETTY McCLURE - RESCINDED
<br />Hearing was resumed on Vacation Resolution No. 3315, being for the vacation of:
<br />the first alley east of Portage Avenue from the north line
<br />of McCartney Street to the south line of the first east -west
<br />alley north of McCartney Street.
<br />having been continued -from June 15, 1970.
<br />Appearing before the Board were petitioner Betty McClure and attorney H.
<br />Theodore Noel], for the vacation. Remonstrators appearing before the Board
<br />against the vacation were Casimir Radecki, owner of Lot 113 and Mrs. Eileen
<br />Halt, owner of Lot 70. Written remonstrances were filed with the Board by
<br />Mr, and Mrs. Gardner Rutherford, owners of Lot 72, and Mrs. Lillian Butts,
<br />owner of Lot 112.
<br />After hearing all:- 'who wished to speak, the Board recessed at 10:45 A.M. and
<br />reconvened at 10:50 A.M. Upon reconvening, the motion was made, seconded and
<br />carried,by a vote of two to one, to withdraw approval of Vacation Resolution
<br />No. 3315 and to deny the said vacation.
<br />IMPROVEMENT RESOLUTION NO. 3316 - BEALE STREET SEWER (RESCINDED)
<br />For the improvement of Beale Street, from Cushing Street to Riverside Drive,
<br />by constructing a local sewer.
<br />The President of the Board read a letter addressed to the Board of Public
<br />Works and Safety from A he St. Joseph County Health Department, 1419 S.
<br />Michigan Street, South Bend, Indiana, stating that "a health hazard exists
<br />in the 600 block area on Beale Street; that raw sewage and waste water is
<br />being pumped to the surface of the ground from a septic tank sewage disposal
<br />system" and recommending that the "City sewer facilities be supplied to
<br />effect an abatement."
<br />Written remonstrances against Improvement Resolution No. 3316-bearing
<br />signatures of 51% or more of the resident property owners on said street who
<br />may be liable for assessment for said improvement, having been filed with
<br />the Board within the 10 day period following the hearing on June 9, 1970,
<br />upon motion made, seconded and carried by a vote of two to one, Improvement
<br />Resolution No. 3316 adopted by the Board on May 18, 1970, and confirmed on
<br />June 9, 1970, was rescinded and the improvement ordered not made.
<br />VACATION RESOLUTION NO. 3317 - MILL RACE INC. - 30 FOOT EASEMENT
<br />Hearing on Vacation Resolution No. 3317, being for the vacation of:
<br />An easement described as that part of the west leg of the East
<br />Race which is located northerly of a line parallel to and 30
<br />feet southerly of the southerly line of Hydraulic.Avenue and
<br />located westerly of the west line of the East Race, which
<br />said west leg of the East Pace is the Race located on the
<br />southeasterly and east sides of Hydraulic Avenue in Section
<br />One and in Section 12, Township 37 north, Range 2 east, in
<br />the City of South Bend, Indiana. -
<br />having been continued from June 8, 1970, for determination in reference to
<br />a drainage problem, was resumed.
<br />Attorneys Bruce Stewart and Charles Boynton appeared before the Board on
<br />behalf of Mill Race, Inc. Following further discussion in reference to the
<br />drainage matter, upon motion made, seconded and unanimously carried, the
<br />matter was continued one week.
<br />COMPLAINT - INDIANA UNIVERSITY STUDENTS
<br />Mr. Jerry Wroblewski, 906 N. Adams Street, and Miss Christina Swanson,
<br />51812 Portage Road, South Bend, Indiana, appeared before the Board and pre
<br />sented a letter of complaint on behalf of the Indiana University of South Bend
<br />Folk Club against the South Bend Police Department for the removal by police
<br />officers of a sign at 941 20th Street reading "FOP Coffee House" alongside
<br />the picture of a pig. The sign having been removed from private property, an
<br />apology was offered by the Board. Chief of Police Loren M. Bussert and Police
<br />Uniform Division Cheif Kenneth E. McDonald were present at the meeting. The
<br />matter is being investigated by the Police Department.
