Trzcinski <br />223 <br />S. <br />Chestnut <br />South <br />Bend, <br />Indiana <br />Mr. Stewart stated the South Bend Range Corporation owns the block of property <br />to the west of Cherry Street in Harlin's Subd ivision; also north of this -par- <br />ticular tract, #15, #14, #13 and approximately two thirds of #12; across the <br />street they own approximately one third of #15; to the south, just north of <br />Napier, they own #29, #30, #31 and #32;-to the south of there, they own #37, #38, <br />#39 and #40. #42 is a little triangular lot; also #41 to the east of #42. In <br />the {fast two grthree years the Corporation expanded its facilities and added to <br />its building by extending to the east. Recently, #29 through #32 were acquired and <br />it is hoped to expand over these lots. <br />Also appearing before the Board was Stanley Przybylinski, 630 N. Johnson Street, <br />South Bend, Indiana, representing the Physical Committee of Model Neighborhood <br />Planning Committee, who stated that the Physical Committee of Model Neighborhood <br />Planning Committee is in favor of the vacation since it is in accordance with <br />the general plan of the Model Cities Neighborhood. However a final vote - <br />cannot be taken until a meeting of the full Board on May 27, 1970. <br />Upon motion made, seconded and unanimously carried the matter was continued <br />one week. <br />HEARING ON VACATION RESOLUTION NO. 3315, 1970 - BETTY McCLURE <br />This being the date set, hearing was held on Vacation Resolution No. 3315, 1970, <br />being for the vacation of: <br />the first alley east of Portage Avenue from the north line of <br />McCartney Street to the south line of the first east -west alley <br />north of McCartney Street. <br />the Clerk tendered proofs of publication of notice in the South Bend Tribune <br />and the Tri County News on May 15 and May 22, 1970, which were found to be <br />sufficient. <br />Appearing for the vacation were the petitioner Betty McClure, 1245 McCartney <br />Street, South:Bend, Indiana, represented by attorney H. Theodore Noell, 210 Lafayette <br />Building, South Bend, Indiana. <br />Mr. Noell stated the alley has presented many problems for Mrs. McClure; that <br />it is difficult to navigate the turn in the alley; that it is difficult to <br />maintain; that trash is allowed to accumulate; and that there is a high bank. <br />Mr. Ndell tendered a letter from the Marathon Oil Company, 1622 Lincolnway East, <br />South Bend, Indiana, stating they have no objection to the vacation, which was <br />ordered filed. <br />Appearing in opposition to the vacation were Mr. and Mrs. Casimir Radecki, <br />1250 Queen Street, South Bend, Indiana, Mrs. Gardner Rutherford, 1233 McCartney <br />Street, South Bend, Indiana, Mr. and Mrs. Gardner Rutherford, 1233 McCartney <br />Street, South Bend, Indiana; Mr. George Butt, 2915 Southeast Drive, South Bend, <br />Indiana, on behalf of Lillian Butt, owner of 1242 Queen Street; and Mrs. Eileen <br />Hall Hollister, 1241 McCartney Street. The main objection was the inability <br />of trash and garbage trucks to make the turn and inconvenience to garages. <br />Also appearing was Mr. Bill Cramer, 1302 Queen Street, South Bend, Indiana, who <br />stated he would have no objection to the closing if Marathon would make the corner <br />so that trucks could get around. <br />
