5/25/70 <br />HEARING ON VACATION RESOLUTION NO. 3312 (PHILLIPA STREET) - MIDWEST TURNKEY <br />BUILDERS. INC. (CONTINUED FROM 5/18/70) <br />Hearing, having been continued from May 18, 1970, was resumed on Vacation No. <br />3312, 1970, being for the vacation of: <br />Phillipa Street, from the north line of Indiana Avenue ex- <br />tending north 106 feet to an unused 10 foot alley, as shown <br />on the recorded plat of South Bend Industrial Addition, <br />Keith Slabaugh, 305 N. Studebaker,,Mishawaka, Indiana, local manager of <br />Midwest Turnkey Builders, Ihc., and attorney Robert L. Miller, 112 Lafayette <br />Building, South Bend, Indiana, appeared before the Board. <br />The Clerk reported notice of this hearing was mailed on May 19, 1970, to <br />William Sheehy, Vice President, Transamerican Properties, Inc., 1700 Waterman <br />Detroit, Michigan, 48209, as requested by Richard W. Kintzele of American <br />Freight Lines, Inc., who appeared at the hearing on May 18, 1970. Neither <br />Mr. Kintzele nor Mr. Sheehy appeared. <br />Mr. Miller stated Mrs. Mary Kruk had been contacted and she has no objection <br />�C to the vacation providing she receives her reversionary part of the vacated <br />Istreet. Mr. Miller',further stated he had investigated the point raised by <br />Mr. Kintzele regarding a third gate in the event of a strike and had found <br />nothing in the taw to substantiate that a third gate could not be picketed. <br />i <br />No one further speaking for or against said vacation, upon motion made, <br />seconded and unanimously carried, the resolution as adopted May 4, 1970, <br />was ratified and confirmed. And the City Engineer was directed to prepare <br />an assessment roll covering the assessment of benefits and the award of damages <br />to surrounding property owners. <br />HEARING ON VACATION RESOLUTION NO. 3313 (ALLEY) - MIDWEST TURNKEY BUILDERS, <br />INC. (CONTINUED FROM 5/18170 <br />Hearing, having been continued from May 18, 1970, was resumed on Vacation No. <br />3313, 1970, being for the vacation of: <br />A 12 foot east -west alley, lying between Dubail Avenue on <br />the north and Calvert Street on the south, and running <br />east from the east line of Carlisle Street to the west <br />line of the first north -south 14 foot alley, and also <br />running from the west line of Warren Street west to the <br />east line of the first north -south 14 foot alley. <br />Keith Slabaugh, 305 N. Studebaker, Mishawaka, Indiana, local manager of Mid- <br />west Turnkey Builders, Inc., and attorney Robert L. Miller, 112 Lafayette <br />Building, South Bend, Indiana, appeared before the Board. <br />Mr. Miller stated the vacation is sought in connection with the building of <br />some houses in this area by Midwest Turnkey Builders, who are the,owners of <br />three of the four lots involved; that the owner of the 4th lot is Mrs. John <br />Coder, 1726 S. Carlisle Street; that Mrs. Coder has been contacted by Mr. <br />Slabaugh and that no objection to the vacation is made by her. <br />No one further appearing in opposition to the vacation and the request appear- <br />ing to be reasonable, the motion was made, seconded and unanimously carried <br />to ratify and confirm the resolution as adopted May 4,_1970.`A6d the City <br />Engineer was directed to prepare an assessment roll covering the assessment <br />of benefits and the award of damages to surrounding property owners. <br />HEARING ON VACATION"RESOLUTION NO. 3314, 1970 - SOUTH BEND RANGE CORPORATION <br />This being the date set, hearing was held on Vacation Resolution No. 3314, 1970, <br />being for the vacation of: <br />Part of Napier Street, located immediately south of and adjacent <br />to Lot 32 as shown in John F. Kirby's Subdivision of Bank Out <br />Lot 83; and <br />a part of Cherry Street, beginning at the northwest corner of Lot <br />37 of John F. Kirby's Subdivision of Bank Out Lot 83; thence north <br />to the northwest corner of Lot 29; thence west to the west line of <br />Cherry Street; thence south along the west line of Cherry Street <br />to a point directly west of the northwest, corner of Lot 37; <br />thence east to the point of beginning. <br />
