<br />HEARING ON g8C8110N RESOLUTION NO, 3312 1970 - PHILLIPA STREET - MIDWEST

<br />This being the date set for hearing on Vacation Resolution No. 3312, 1970,
<br />being for the vacation of:
<br />Phillipa Street -from the north line of Indiana Avenue
<br />extending north 106 feet to an unused'10 foot alley, as
<br />shown on the recorded plat of South Bend Industrial
<br />Addition.
<br />proofs of publication in the South Bend Tribune and the Tri County News on May
<br />8 and May 15, 1970, were tendered by the Clerk and found to be proper.
<br />Appearing in opposition to the vacation was Richard W. Kintzele of Trans-
<br />american Freight Lines, Inc., 1530 S. Olive Street.
<br />Also appearing was Mrs. Mary Kruk, 2305 W. Indiana Avenue, South Bend, Indiana
<br />who has no objection to the vacation if one-half of the street reverts to her.
<br />Robert L. Miller, attorney for petitioner, being unable to be present, upon
<br />motion made, seconded and carried, the matter was continued one week.
<br />HEARING ON VACATION RESOLUTION NO. 3313, 1970 - ALLEY - MIDWEST TURNKEY BUILDERS
<br />This being the date set for hearing on Vacation Resolution No, 3313, 1970,
<br />being for the vacation of:
<br />a 10 foot east -west alley, lying between Dubail Avenue on the
<br />north and Calvert Street on the south, and running east
<br />from the east line of Carlisle Street to the west line of
<br />the first north -south 14 foot alley, and also running from the west
<br />line of Warren Street west to the east line of the first north -south
<br />14 foot alley.
<br />proofs of publication in the South Bend Tribune and the Tri County News on May
<br />8 and May 15, 1970, were tendered by the C1'erkand fouridt-to be proper.
<br />Appearing in oppositon to the vacation were Mrs. John Coder, 1726 S. Carlisle
<br />Street, South Bend, Indiana; Mrs. Anna Gates, 1810 S. Carlisle Street, South
<br />Bend, Indiana; and Mrs. Robert Bonczynski, 1809:S. Warren Street, South Bend,
<br />Indiana.
<br />Mrs. Jean Smits, e. Jefferson Road,South Bend, Indiana, owner of 1709 S.
<br />Warren Street, appeared before the Board and has no objection to the vacation.
<br />Robert L. Miller, attorney for petitioner, being unable to be present, upon
<br />motion made, seconded and carried, the matter was continued one week.
<br />REQUEST TO ADVERTISE FOR BIDS FOR CONSTRUCTION OF DRAINAGE'AND STREET
<br />IMPROVEMENTS - CHIPPEWA AT MAIN
<br />Upon motion made, seconded -and unanimously carried, the Board approved the
<br />request of the City Engineer for permission to advertise for bids for the
<br />construction of drainage facilities and street improvements on Chippewa Avenue
<br />at Main Street, and set June 1, 1970, as the date for receiving bids. The Clerk
<br />was directed to give notice by publication in the South .Bend Tribune and the
<br />Tri County News on May 22 and May 29, 1970.
<br />SEWER CONSTRUCTION AGREEMENT - KENSINGTON FARMS
<br />Sewer extension agreement under date of May 16, 1970, between the City of South
<br />Bend and Owen F. and Mary M. Tyler, 60708 Gotham Drive, South Bend, Indiana,
<br />owners of Lot 124, Kensington Farms, Section 3, Part 1, was executed by the
<br />Board.
<br />PRELIMINARY PLANS AND SPECIFICATIONS FILED
<br />ADOPTION OF IMPROVEMENT RESOLUTION NO. 3316, 1970 - BEALE STREET'(SEWER)
<br />Clyde E. Williams and Associates, Inc.,.`consulting engineers, file with the ';Board
<br />preliminary plans, cost estimate and resolution for the improvement of Beale
<br />Street, from Bushing to Riverside, by constructing a local sewer, and the Board,
<br />upon motion made, seconded and unanimously carried, adopts Improvement
<br />Resolution No. 3316, 1970, for said improvement.
