Mi <br />3/30/70 <br />RECOMMENDATION TO REJECT ALL BIDS FOR DRAPERIES <br />Upon motion made, seconded and carried, the Board approved the recommendation <br />of the Purchasing Director to reject all bids for draperies received on <br />March 23, 1970, and to readvertise'for bids on bonded materials only. April <br />13, 1970 was the date set for receiving such bids and the Clerk was directed <br />to give notice by publication in the South Bend Tribune and the Tri County <br />News on April 3 and April 10, 1970. <br />HEARING ON ASSESSMENT ROLL - RESOLUTION NO. 3300 - OPENING FELLOWS STREET <br />This being the date set for hearing on the assessment roll in Resolution No. <br />3300, being for the opening of Fellows Street, more. particularly described <br />as follows: <br />A public.street 60 feet in width running north and south in <br />the northwest Quarter of Section 25, Township 37 .north <br />r- Range 2 east, and connecting at both ends with Fellows <br />0C Street as presently existing and constituting an extension <br />thereof from Walter Street to the north line of the south- <br />east Quarter of the northwest Quarter of said Section, <br />the centerline of said proposed extension to coincide with <br />the centerline of Fellows Street as presently existing at <br />both ends. <br />the Clerk tendered proofs of publication of notice in the South Bend Tribune <br />and the Tri County News on March 6 and March_ 13 and March 20, 1970, which were <br />read and found to be sufficient. <br />Appearing before the Board were F. Gerard Feeney, attorney for heirs of Robert <br />Will Maurice, deceased, Charles.W. Magner, administrator with the will <br />annexed of the estate of Robert William Maurice, deceased, Mr. and Mrs. George <br />Battles, 712 E. Angela Boulevard, South Bend, Indiana, and Mr. and Mrs. Dale <br />Murphy, 60950 Miami Road, South Bend, Indiana. Also appearing before the <br />Board was Joseph B. Dosmann, 4312 S. Fellows Street. <br />Following discussion in reference to acquisition of the 60 foot strip of land <br />from the heirs of Robert William Maurice Estate for street and utility <br />purposes, the following proposal was submitted to and accepted by the heirs <br />of Robert William Maurice: <br />"In exchange for a deed to the 60 foot strip of land, the City <br />of South Bend will: <br />(1) Construct a sanitary sewer for the entire length of the <br />parcel of land to be dedicated to the City with 14 lateral <br />sewer taps no less than 15 feet long; <br />(2) Construct a servicable all weather roadway with a gravel <br />base and a hot asphaltic concrete surface of not less <br />than 3 inches and 24 feet in width also for the entire <br />length of the dedicated parcel; <br />(3) Agree that the profile of the centerline of the roadway <br />shall conform to the existing contour of the land; however, <br />In no case shall a fill exceed one foot in depth above <br />the existing grades. <br />"The City of South Bend hereby agrees to .install the above <br />described improvements at no cost to the abutting property owner, <br />nor shall there be any future assessments for the above described <br />improvements. <br />"The City further agrees to install a culvert to carry the drainage <br />from the west side of the roadway to the east side at the low point. <br />"The City further agrees to remove the house in its entirety, with <br />the understanding that the administrator does hereby grant permission <br />to the City t6 femove that part of the structure which is outside <br />the deeded right of way. <br />
