HEARING ON VACATION RESOLUTION NO. 3293 - MENTAL HEALTH CENTER (CONY FROM 6/30/601 Hearing on vacation Resolution No. 3293 for the vacation of the north -south alley between St. Louis Street and St. Peter Street, from Colfax Avenue north 198 feet to the first east west alley, having been continued from June 30, 1969, at the request of attorneys John Montgomery and Robert L. Miller for the purpose of reaching an agreement concerning ingress and egress of trucks of E. R. Have), represented by Mr. Miller, and Mr. Montgomery and Mr. Miller now having ad- vised the Board such agreement has been reached, it was moved, seconded and carried that the Resolution be finally approved, and the City Engineer was directed to prepare an assessment roll. STREET LIGHTING AGREEMENT - INDIANA & MICHIGAN ELECTRIC COMPANY Upon motion made, seconded and carried, the Board approved a contract between the City of South Bend and the Indiana and Michigan Electric Company covering street lighting services for a period of five years from March 1, 1970. VACATION RESOLUTION NO. 3310 - HOMER W. FITTERLING Homer W. Fitterling, on September 20, 1962, having filed a petition in the St. Joseph Guperior Court No. 1, Cause No. B-7990, and an order having been entered by the St. Joseph Superior Court, for the vacation of: the entire plat known as Indiana Produce and Warehouse Company Sunset Park Addition to the City of South Bend, a portion of the plat known as Richland Second Addition to the City of South Bend and a portion of the plat known as Olive Place Addition to the City of South Bend, St. Joseph County, Indiana. it was moved, seconded and carried that a copy of the order of the St. J oseph Superior Court, Cause No. Ba7990, be assigned Vacation Resolution No. 3310, 1970, for identification and filing purposes. CONTRACTOR'S BOND CANCELLED - JOHN VANEK Upon recommendation of the City Attorney, the Board approved the request of Western Surety Company for cancellation of Contractor's Bond ##4284027 for John Vanek, d/b/a Vanek Excavating Company, 1232 Terrace Court, South Bend, Indiana, as of March 30, 1970.
