13 <br />3/9/70 <br />AGREEMENT FOR SEWER CONSTRUCTION - CREST MANOR <br />Upon motion made, seconded and unanimously carried, the Board approved and <br />executed sewer construction agreement with Crest Manor Development Corpora- <br />tion for the installation of a combination sanitary and storm sewer to <br />service certain lands belonging to Crest Manor Development Corporation, <br />located southerly of Jackson Road and easterly of Miami Street, more par- <br />ticularly set out as follows: <br />Beginning at the northwest corner of the Park (Retention Area) <br />as shown on the recorded plat of Crest Manor, Section 4 <br />Subdivision (Bk. 22 Pg.C) at a manhole located in the utility. <br />easement at the common corner of Lots 181 and 182 and the Park <br />Area; thence southeasterly across the Park Area 326 lineal -:feet <br />to a manhole located in the utility easement at the common <br />corner of Lots 184 and 186 and the Park Area; thence southeasterly <br />through the utility easements adjoining Lots 184, 185, 186 and 152 <br />to a manhole located at the common corner of Lots 150, 151 and <br />152; thence southeasterly through the utility easement between Lots <br />150 and 152 to a manhole located in the utility easement at the <br />r•. <br />common corner of Lots 150 and 152 Crest Manor, Section 4 <br />JC <br />and Lot 221 and the Park Area of Crest Manor, Section 8, Part 3 <br />Subdivision as recorded (Bk. 23, Pg. C); thence southeasterly <br />�= <br />through the utility easement located at the rear (east end) of <br />�-' <br />Lots 221, 222 and 223 Crest Manor, Section 8, Part 3, to a man- <br />hole located in the utility easement at the common corners of <br />Lots 223, 224 and 225; thence southwesterly through the utility <br />easement between Lots 224 and 225 to a manhole located -in the <br />street (Berkshire Drive) right of way at the common corners of <br />Lots 214 and 215; thence southeasterly through the utility easement <br />between Lots 214 and 215 to a manhole located in the utility <br />easement at the southern common corners of Lots 214 and 215 Crest <br />Manor, Section 8, Part 3. (The sewer from the beginning of this <br />description to this last described manhole is a 21 inch combined <br />sanitary storm sewer. The balance of the description covers <br />only a 12 inch sanitary sewer); thence southwesterly through <br />a utility easement at the rear (west end) of Lots numbered 259, 260, <br />261 and 262, Crest Manor, Section 9, Part 1, Subdivision as <br />recorded (Bk. 23, page C) to a manhole located in the utility <br />easement at the western common corners of Lots 262 and 263; <br />thence southwester y through the utility easement at the rear <br />(western end) of Lots 263 and 264 to a manhole located in the <br />utility easement at the southwestern corner of Lot 264; thence <br />through the following described easement given to the City of <br />South Bend in September of 1968 by Crest Manor Development <br />Corporation (beginning point this easement overlaps the last <br />described manhole at the southwestern corner of Lot 264, <br />Crest Manor Section 9, Part 1, and extends generally in a <br />westerly and southerly direction) a strip of land in the west <br />Half of Section 31, Township 37 north, Range 3 east, Centre <br />Township, St. Joseph County, Indiana, 10 feet in width tying <br />5 feet either side of the following described lines: <br />Beginning at a point which is 27 feet easterly of the southern <br />most corner of Lot 209 in Crest Manor, Section 6, as recorded; <br />thence south 430 56' 49" west, 135 feet to the western most <br />line of Lot 266 in Crest Manor, Section 10, as proposed; also <br />a strip of land in such west Half of Section 31, 15 feet in <br />width, lying 7.5 feet either side of the following described <br />lines: Beginning at the western most corner of said Lot 266 <br />in Crest Manor, Section 10, as proposed; thence south 390 33' <br />55" east, 357 feet; thence south 490 54' 00" west, 230 feet; <br />thence south 230 20' 41" east, 139 feet to the south 1-ine of <br />such Crest Manor plat, Section 10, as proposed, and being also <br />the north line of Kensington Farms plat, Section 5 as proposed. <br />The above described sewer is the extension of a previously re- <br />corded sewer, entered into pursuant to Chapter 182 of the 1955 <br />Acts of the Indiana General Assembly by Al Nall and Associates, <br />Inc., and recorded in Misc. Record Book 220, beginning at page <br />627, St. Joseph County Recorder's office. <br />
