431 8/28/72 No remonstrators having appeared and no written remonstrances having been filed, upon motion made, seconded and unanimously carried, said Resolution adopted on the 14th day of August, 1972 is ratified and confirmed and said street is vacated. The City Engineer is directed to prepare an assessment roll showing the award of damages and the assessment of benefits to the surrounding properties. VACATION RESOLUTION NO. 3368 1972 - ST. PETER STREET-ST. JOSEPH HOSPITAL Area Plan Commission having filed with the Board its recommendation for the vacation of St. Peter Street from the South Right of way line of Cedar Street running south 410' to the North right of way line of Madison Street, the following vacation resolution was adopted: VAeAVION RBgOlUtION NOS. 3368,1972 RESOLVED BY THE BOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF SOUTH BEND, INDIANA, That it is desirable to vacate the following: St. Peter Street from the South right-of- way line of Cedar Street running south 4101 V to the North right-of-way line of Madison U Street Reserving the rights and easements of all Utilities and the Municipal City of South Bend, Indiana, to construct and maintain any facilities, including, but not limited to, the following: electric, telephone, gas, water,wewer, surface water control structures and ditches within the vacated right of way, unless such rights are released by the individual Utilities. The following property may be injuriously or benefically affected by such vacation: Lots 10, it and 12 of Howard's Sub S. part of Lot 8 of Cottereli's 1st Add. Lots 13, 14 and 15 of Howard's Sub. N. part of Lot 8 of Cotterell's Sub. 1st addition Notice of this Resolution shall be published on the 1st day of September and on the 8th day of September, 1972 in the South Bend Tribune and the Tri County News. This Board, at its office on the lith day of September, 1972 at 9:30 O'clock A.M., will hear and receive remonstrances from all persons interested in or affected by these proceedings.
