3381 6/12/72 PETITION TO VACATE A PORTION OF ST. PETER STREET - ST. JOSEPH HOSPITAL A petition was received asking for the vacation of St. Peter Street between Madison Street and Cedar Street by St. Joseph's Hospital. $75.00 was deposited for costs. Upon motion duly made, seconded and carried, the petition was referred to the Engineering Department and the Area Plan Commission simultaneously forstudy and recommendation. ASSESSMENT ROLL HEARING - VACATION RESOLUTION NO. 3358,1972 - INDIANA & MICHIGAN ELECTRIC COMPANY This being the date set, hearing was had on the Assessment Roll in Vacation Resolution No. 3358,1972, for the vacation of a; part of the first North -South alley West of Ironwood Drive, running south 133.E+5 feet from the South Right of way line of the Grand Trunk and Western Railroad. The Clerk tendered proofs of publication of notice in the South Bend Tribune and the Tri County News on May 26, June 2 and June 9, 1972 and same were found to be sufficient. No remonstrators having appeared and no written remonstrances having been received, upon motion made, seconded and carried, the Assessment Roll showing no net damages and no net benefits was approved as adopted and said Resolution in all things ratified and confirmed and said proceedings closed. REMONSTRANCE FILED - PAVING ALLEY A remonstrance was filed in ;the matter of the paving of an alley from Oakwood Drive to Lathrop Street between Inglewood Place and Hollywood Place. The Clerk was instructed to return the petition to Mr. and Mrs. Kalman, informing them remonstrances must be filed at the time of the public hearing on Barrett Law projects. LETTER FROM STATE BOARD OF HEALTH A letter from the State Board of Health, addressed to Clay Utilities, Inc., with reference to approval of plans and specifications for sewer force main and lift station was ordered filed. RESOLUTION NO. f - 6/12/72 A RESOLUTION AUTHORIZING THE SALE OF CERTAIN PARCELS OF REAL ESTATE OWNED BY THE CITY OF SOUTH BEND, INDIANA WHEREAS, the Board of Public Works and Safety of the City of South Bend has compiled a current detailed inventory of all real property owned by the City of South Bend, Indiana, pursuant to Section 30A-1 of the Municipal Code of the City of South Bend; and WHEREAS, the Board of Public Works and Safety has reviewed said inventory of real property and it now finds that certain of the parcels of real estate now owned by the City are not necessary to the public use and are not set aside by state or city law for public pur- poses pursuant to Section 30A-2 of the Municipal Code of the City of South Bend; and WHEREAS, the Board of Public Works. and Safety now wishes to take the necessary action to make it possible for the Board, in the future, to sell said parcels of real estate pursuant to Chapter 30A of the Municipal Code of the City of South Bend. NOW, THEREFORE, BE IT RESOLVED, by the Board of Public Works and Safety of the City of South Bend, Indiana: 1. That the parcels of real estate owned by the City, contained in the list attached hereto and made a part of this resolution, are not necessary to the public use and are not set aside by state or city taw for public purposes.
