3381 <br />6/12/72 <br />PETITION TO VACATE A PORTION OF ST. PETER STREET - ST. JOSEPH HOSPITAL <br />A petition was received asking for the vacation of St. Peter Street <br />between Madison Street and Cedar Street by St. Joseph's Hospital. $75.00 <br />was deposited for costs. Upon motion duly made, seconded and carried, <br />the petition was referred to the Engineering Department and the Area Plan <br />Commission simultaneously forstudy and recommendation. <br />ASSESSMENT ROLL HEARING - VACATION RESOLUTION NO. 3358,1972 - INDIANA <br />& MICHIGAN ELECTRIC COMPANY <br />This being the date set, hearing was had on the Assessment Roll in <br />Vacation Resolution No. 3358,1972, for the vacation of a; part of the <br />first North -South alley West of Ironwood Drive, running south 133.E+5 <br />feet from the South Right of way line of the Grand Trunk and Western <br />Railroad. <br />The Clerk tendered proofs of publication of notice in the South Bend <br />Tribune and the Tri County News on May 26, June 2 and June 9, 1972 <br />and same were found to be sufficient. No remonstrators having appeared <br />and no written remonstrances having been received, upon motion made, <br />seconded and carried, the Assessment Roll showing no net damages and <br />no net benefits was approved as adopted and said Resolution in all <br />things ratified and confirmed and said proceedings closed. <br />REMONSTRANCE FILED - PAVING ALLEY <br />A remonstrance was filed in ;the matter of the paving of an alley from <br />Oakwood Drive to Lathrop Street between Inglewood Place and Hollywood <br />Place. The Clerk was instructed to return the petition to Mr. and Mrs. <br />Kalman, informing them remonstrances must be filed at the time of the <br />public hearing on Barrett Law projects. <br />LETTER FROM STATE BOARD OF HEALTH <br />A letter from the State Board of Health, addressed to Clay Utilities, <br />Inc., with reference to approval of plans and specifications for sewer <br />force main and lift station was ordered filed. <br />RESOLUTION NO. f - 6/12/72 <br />A RESOLUTION AUTHORIZING THE SALE OF <br />CERTAIN PARCELS OF REAL ESTATE OWNED <br />BY THE CITY OF SOUTH BEND, INDIANA <br />WHEREAS, the Board of Public Works and Safety of the City <br />of South Bend has compiled a current detailed inventory of all real <br />property owned by the City of South Bend, Indiana, pursuant to Section <br />30A-1 of the Municipal Code of the City of South Bend; and <br />WHEREAS, the Board of Public Works and Safety has reviewed <br />said inventory of real property and it now finds that certain of the <br />parcels of real estate now owned by the City are not necessary to the <br />public use and are not set aside by state or city law for public pur- <br />poses pursuant to Section 30A-2 of the Municipal Code of the City of <br />South Bend; and <br />WHEREAS, the Board of Public Works. and Safety now wishes to <br />take the necessary action to make it possible for the Board, in the <br />future, to sell said parcels of real estate pursuant to Chapter 30A <br />of the Municipal Code of the City of South Bend. <br />NOW, THEREFORE, BE IT RESOLVED, by the Board of Public <br />Works and Safety of the City of South Bend, Indiana: <br />1. That the parcels of real estate owned by the City, <br />contained in the list attached hereto and made a <br />part of this resolution, are not necessary to the <br />public use and are not set aside by state or city <br />taw for public purposes. <br />
