122R <br />2/28/72 <br />HEARING ON VACATION RESOLUTION NO. 3355 - JULIUS & EDITH TUCKER <br />February 22, 1972 having been set as the date for holding a hearing on <br />Vacation Resolution No. 3355, and it having been continued until this <br />date, hearingtwas now held on Vacation Resolution No. 3355, 1972, for <br />the vacation of The East West alley between Colfax and Washington <br />Avenue, running West from the West line of Niles Avenue 150' + to the <br />East line of the East Race, said alley running between Lots h45 and <br />46 in a part of the original Plat of the Town -of Lwell, now a part of, <br />the City of South Bend. <br />The Clerk tendered proofs of publication of notice in the South Bend <br />Tribune and the Tri County News on February 11 and February 18, 1972 <br />which were found to be sufficient. <br />Mr. Frederick K. Baer, attorney for Julius and Edith Tucker, appeared <br />before the Board, as did Mr. Herbert DeCroes, owner of adjacent property. <br />No remonstrators appeared and no written remonstrances were received. <br />Upon motion made, seconded and unanimously carried, said resolution <br />adopted on the 7th day of February, 1972 was ratified and confirmed <br />and said alley vacated. <br />The City Engineer is directed to prepare an assessment roll showing <br />the award of damages and assessment of benefits to surrounding <br />properties. <br />PETITION TO VACATE A PORTION OF MARSHALL STREET - OSTEOPATHIC HOSP. <br />Osteopathic Hospital, but it's attorney Robert E. Zimmerman, files <br />its petition to vacate Marshall Street from the east line of Holiday <br />Drive projected south to the north line of Lot numbered eight (8) <br />as shown on the recorded plat of Tuxedo Park First Addition to the <br />City of South Bend to the east line of the West one-half (2) of <br />the Northwest one -quarter (4) of Section eight (8), Township Thirty- <br />seven (37) north, range three (3) east, in the City of South Bend <br />Indiana, and deposits $75.00 to pay for costs. Upon motion made, <br />seconded and unanimously carried, the petition is referred to the <br />Engineering Department and the Area Plan Commission simultaneously, <br />for study and recommendation. <br />ASSESSMENT ROLL HEARING - VACATION RESOLUTION NO. 3351 - Department <br />of Redevelopment <br />This being the date set, hearing was held on the Assessment roll <br />in Vacation Resolution no. 3351, 1972, for the vacation of the <br />following: <br />Lincoln Way East - from 55 feet south of Jefferson Street <br />to St. Joseph Street <br />East Jefferson Street - from St. Joseph Street to the curve <br />on Jefferson -Wayne Connector Street. <br />East Washington Street from St. Joseph Street to Artesian <br />Avenue. <br />Artesian Avenue - from Washington Street to the southerly end <br />of Artesian Avenue. <br />The clerk tendered proofs of publication of notice in the South Bend <br />Tribune and the Tri County News which were found to be sufficient. <br />No remonstrators having appeared and no written remonstrances having <br />been received, upon motion made, seconded and unanimously carried, <br />the assessment roll showing no net damages and no net benefits was <br />approved as adopted and said Resolution in all things ratified and <br />confirmed and said proceedings closed. <br />1 <br />
