152 12/20/71 Upon motion made, seconded and unanimously carried, the Board accepted and approved said recommendation as follows: To reduce the assessment against Lots 3 and 4 of Hilltop Addition (John Zivkovich, 603 Farneman Street) by $50.00; To reduce the assessment against Lot 4 of High Point Addition (Leo Sobierajski, 626 Donmoyer Street) by $14.33; To assess the City of South Bend the sum of $64.33, HEARING ON VACATION RESOLUTION NO. 3350 - SOUTH BEND COMMUNITY SCHOOL CORP. This being the date set, hearing was had on Vacation Resolution No. 3350, 1971, for the vacation of: Longley Avenue between Meade Street and Olive Street; also, the first east -west alley north of Longley Avenue, between Meade Street and Olive Street; also, the first north -south alley east of Meade Street from Longley Avenue north to the first east -west alley north of Longley Avenue; also, Fremont Street from Longley Avenue north to the first east -west alley. The Clerk tendered proofs of publication'of notice in the South Bend Tribune and the Tri County News on December 10 and December 17, 1971, which were found to be sufficient. Jack C. Dunfee, attorney, appeared on behalf of the South Bend Community Schood Corporation. No remonstrators appeared and no written remonstrances were received. Upon motion made, seconded and carried unanimously, said resolution adopted on December 6, 1971, was ratified and confirmed and said streets and alleys vacated. The City Engineer is directed to prepare an assessment roll showing the award of damages and assessment of benefits to surrounding properties. ASSESSMENT ROLL FILED - VACATION RESOLUTION NO. 3349 1971 - GATES CHEVROLET Lloyd S. Taylor, City Engineer, files assessment roll as follows: "VACATION RESOLUTION NO. 3349, 1971 "RESOLVED BY THE BOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF SOUTH BEND, INDIANA, That it is desirable to vacate the following: The east -west alley between Wayne Street and Western Avenue from William Street to Franklin Street. Also, the north -south alley between William Street and Franklin Street from Wayne Street to Western Avenue. "Reserving the rights and easements of all utilities and the Municipal City of South Bend, Indiana, to construct and maintain any facilities, including, but not limited to, the following: electric, telephone, gas, water, sewer, surface water control structures and ditches, within the vacated right of way, unless such rights are released by the individual utilities. "The following property may be injuriously or beneficially affected by such vacation: All of the area bounded by Wayne Street on the north, Franklin Street on the east, Western Avenue on the south and William Street on the west.
