152 <br />12/20/71 <br />Upon motion made, seconded and unanimously carried, the Board accepted and <br />approved said recommendation as follows: <br />To reduce the assessment against Lots 3 and 4 of Hilltop Addition <br />(John Zivkovich, 603 Farneman Street) by $50.00; <br />To reduce the assessment against Lot 4 of High Point Addition <br />(Leo Sobierajski, 626 Donmoyer Street) by $14.33; <br />To assess the City of South Bend the sum of $64.33, <br />HEARING ON VACATION RESOLUTION NO. 3350 - SOUTH BEND COMMUNITY SCHOOL CORP. <br />This being the date set, hearing was had on Vacation Resolution No. 3350, <br />1971, for the vacation of: <br />Longley Avenue between Meade Street and Olive Street; also, <br />the first east -west alley north of Longley Avenue, between <br />Meade Street and Olive Street; also, the first north -south <br />alley east of Meade Street from Longley Avenue north to the <br />first east -west alley north of Longley Avenue; also, Fremont <br />Street from Longley Avenue north to the first east -west alley. <br />The Clerk tendered proofs of publication'of notice in the South Bend Tribune <br />and the Tri County News on December 10 and December 17, 1971, which were <br />found to be sufficient. <br />Jack C. Dunfee, attorney, appeared on behalf of the South Bend Community <br />Schood Corporation. No remonstrators appeared and no written remonstrances <br />were received. Upon motion made, seconded and carried unanimously, said <br />resolution adopted on December 6, 1971, was ratified and confirmed and <br />said streets and alleys vacated. <br />The City Engineer is directed to prepare an assessment roll showing the <br />award of damages and assessment of benefits to surrounding properties. <br />ASSESSMENT ROLL FILED - VACATION RESOLUTION NO. 3349 1971 - GATES CHEVROLET <br />Lloyd S. Taylor, City Engineer, files assessment roll as follows: <br />"VACATION RESOLUTION NO. 3349, 1971 <br />"RESOLVED BY THE BOARD OF PUBLIC WORKS AND SAFETY OF THE <br />CITY OF SOUTH BEND, INDIANA, That it is desirable to vacate the <br />following: <br />The east -west alley between Wayne Street and <br />Western Avenue from William Street to Franklin <br />Street. Also, the north -south alley between <br />William Street and Franklin Street from Wayne <br />Street to Western Avenue. <br />"Reserving the rights and easements of all utilities and <br />the Municipal City of South Bend, Indiana, to construct and <br />maintain any facilities, including, but not limited to, the <br />following: electric, telephone, gas, water, sewer, surface water <br />control structures and ditches, within the vacated right of way, <br />unless such rights are released by the individual utilities. <br />"The following property may be injuriously or beneficially <br />affected by such vacation: <br />All of the area bounded by Wayne Street on the <br />north, Franklin Street on the east, Western Avenue <br />on the south and William Street on the west. <br />Net benefits - $00.00 <br />Net damages - $00.00 <br />"Respectfully submitted this 20th day of December, 1971. <br />s/ Lloyd S.
