12/6/71 <br />Request for sub -standard property owners to appear 12/20/71 <br />Upon motion made, seconded and carried, the Board approved the request of <br />the Sub -Standards Director for the following persons to appear before the <br />Board December 20, 1971, in reference to the sub -standard condition of <br />the following properties: <br />7292 S. Rush Street - St. Joseph County Commissioners <br />1611 S. William Street - Emil Weber by Charles W. Hahn <br />724 George Street - Harold C. Personette <br />1613 S. Carroll Street - Virgil A. and Bertie V. Potter <br />HEARING ON VACATION RESOLUTION NO. 3349 - GATES CHEVROLET CORPORATION <br />This being the date set, hearing was had on Vacation Resolution No. 3349 <br />for the vacation of: <br />The east -west alley between Wayne Street and Western <br />Avenue from William Street to Franklin Street. Also <br />the north -south alley between William Street and <br />Franklin Street from Wayne Street to Western Avenue. <br />The Clerk tendered proofs of publication of notice in the South Bend Tribune <br />and the Tri County News on November 26 and December 3, 1971, which were <br />found to be sufficient. <br />2IJ <br />w Attorney William F. Mclnerny and Van E. Gates, President of petitioner <br />Gates Chevrolet Corporation appeared before the Board. Mr. Mclnerny <br />stated the north -south alley is not being used as an alley and that the <br />east -west alley may or may not exist and that it would be advantageous <br />to vacate both alleys. <br />No remonstrators appeared and no written remonstrances were received. <br />Upon motion made, seconded and unanimously carried, Vacation Resolution No. <br />3349 adopted November 22, 1971, was ratified and confirmed and the alleys <br />vacated. <br />The City Engineer is directed to prepare an assessment.roll showing the <br />assessment of benefits and award of damages to surrounding properties. <br />AREA PLAN COMMISSION RECOMMENDATION <br />VACATION RESOLUTION NO. 3350, 1971 ADOPTED <br />SOUTH BEND SCHOOL CORPORATION <br />Area Plan Commission files with the Board its favorable recommendation for <br />the vacation of: <br />Longley Avenue between Meade Street and Olive Street; <br />the first east -west alley between Meade Street and Olive <br />Street north of Longley Avenue; the first north -south <br />alley east of Meade Street and running north from <br />Longley Avenue; and Fremont Street from Longley Avenue <br />north to the first east -west alley. <br />Upon motion made, seconded and unanimously carried, the following <br />resolution was adopted: <br />"VACATION RESOLUTION NO. 33500 1971 <br />"RESOLVED BY THE BOARD OF PUBLIC WORKS AND SAFETY OF THE <br />CITY OF SOUTH BEND, INDIANA, That it is desirable to vacate the <br />following: <br />Longley Avenue between Meade Street and Olive Street; <br />also, the first east and west alley north of Longley <br />Avenue between Meade Street and Olive Street; also, the <br />first north and south alley east of Meade Street from <br />Longley Avenue north to the first east and west alley <br />north of Longley Avenue; also, Fremont Street from Longley <br />Avenue north to the first east and west alley. <br />Reserving the rights and easements of all Utilities and the <br />Municipal City of South Bend, Indiana, to construct and maintain any <br />facilities, including, but not limited to, the following: electric, <br />telephone, gas, water, sewer, surface water control structures and <br />
