114 <br />12/6/71 <br />ditches within the vacated right of way, unless such rights are re- <br />leased by the individual Utilities. <br />"The following property may be injuriously or beneficially <br />affected by such vacation: <br />Lots numbered 249 to 264, both inclusive, in Kaley's <br />Third Subdivision and the Kaley School property on a <br />tract of land bounded by Longley Avenue, OliveStreet, <br />Roger Street and Meade Street. <br />"Notice of this Resolution shall be published on the lOth <br />day of December and the 17th day of December, 1971, in the South Bend <br />Tribune and the Tri County News. <br />"This Board, at its office, on the 20th day of December, <br />1971, at 9:30 o'clock, A.M., will hear and receive remonstrances from <br />all persons interested in or affected by these proceedings. <br />"Adopted this 6th day of December, 1971. <br />BOARD OF PUBLIC WORKS AND SAFETY <br />s/ Lloyd S. Diesel Fuel #1 (bulk transport) @ .1225t per gala <br />Diesel Fuel #2 (bulk transport) @ .1150� per gal. <br />WITHDRAWAL OF PETITION TO VACATE PORTIONS OF ST. JOSEPH STREET, WESTERN <br />AVENUE, CARROLL STREET, WAYNE AND SPENCER STREETS AND THREE ALLEYS <br />(NORTH OF NEW POST OFFICE SITE) - DEPARTMENT OF REDEVELOPMENT <br />Area Plan Commission files with the Board its report that the Department <br />of Redevelopment, at the hearing held by the Area Plan Commission on <br />November 16, 1971, withdrew its petition to vacate: <br />Portions of St. Joseph Street, Western Avenue, <br />Carroll Street, Wayne and Spencer Streets, and three <br />alleys (north of the new post office site). <br />Upon motion made, seconded and carried, the Board accepted such withdrawal <br />and tMe matter of the petition to vacate said streets and alleys filed <br />with the Board on September 20, 1971, is now terminated. <br />WITHDRAWAL OF PETITION TO VACATE WESTERN AVENUE MICHIGAN TO LINCOLNWAY <br />EAST - DEPARTMENT OF REDEVELOPMENT <br />Area Plan Commission files with the Board its report that the Department <br />of Redevelopment,at the hearing held by the Area Plan Commission.on <br />November 16, 1971, withdrew its petition to vacate <br />Western Avenue, from Michigan Street east to Lincolnway <br />east, being that portion not vacated previously by <br />Resolution No. 3337. <br />Upon motion made, seconded and carried, the Board accepted such withdrawal <br />and the matter of the petition to vacate said street filed with the Board <br />
