113 <br />10/26/71 <br />STREET DEPARTMENT - REQUEST TRANSFER OF FUNDS <br />Upon motion made, seconded and unanimously carried, the Board approved the <br />request of the Street Department for the transfer of $25,000.00 from <br />Account MVH-63 (retirement) to Account MVH-722 for the purchase of snow <br />plows and salt spreaders. The request was referred to the Legal Depart- <br />ment for the preparation of an ordinance for the consideration of the <br />Common Council. <br />EXCESS TELEPHONES - CITY DEPARTMENTS <br />The Building Commissioner having made a survey of all City Departments <br />reports that 13 phones can be dispensed with and that the Indiana Bell <br />Telephone Company has been directed to remove the following: <br />Mayor's office - 1 telephone <br />City Attorney's office - 1 telephone <br />Department of Redevelopment - 3 telephones <br />Common Council chambers - 6 telephones <br />Park Department - 2 telephones <br />et+ <br />ASSESSMENT ROLL FILED - RESOLUTION NO. 3348, 1971 FOR OPENING STREET <br />Lloyd S. Taylor, City Engineer, files assessment roll in Resolution No. <br />U <br />33481 1971, for the opening and extension of the street known as North <br />Shore Drive, South Bend, Indiana, from its existing termination point <br />at the south railroad right of way of the St. Joseph Valley Railroad <br />Company, now Michigan Central Railroad and/or Michigan Airline Railroad <br />Company, Penn Central Transportation Company, lessee thereof, to the north <br />line of such railroad right of way. Such involved opening and extension of <br />such street is situated within the limits of the city of South Bend, Indiana. <br />The City of South Bend, Indiana, assumes no responsibility for either erection <br />or maintenance of crossing protection or maintenance of the crossing surface <br />or any liability (either public liability or property damage liability) as <br />a result of the opening of said street; and that th6'City of South Bend, Indiana <br />is neither injuriously nor beneficially affected by the adoption of said <br />resolution; and that the property lying north of the right of way of the <br />St. Josept Valley Railroad Company, now Michigan Central Railroad and/or <br />Michigan Airline Railroad Company, Penn Central Transportation Company, <br />lessee thereof, is benefited to the extent of access to the property; and <br />that no other property is injuriously or beneficially affected by the <br />adoption of this resolution.' <br />Total net damages $00.00 <br />Total net benefits $00.00 <br />Upon motion made, seconded and carried, the Board adopted said assessment <br />roll and set 9:30 A.M. on November22, 1971, as the date for hearing all <br />persons interested in or affected by said street opening. The Clerk is <br />directed to give notice by publication in the South Bend Tribune and the <br />Tri County News on October 29, November 5 and November 12, 1971. <br />AGREEMENT - CITY OF SOUTH BEND WITH CRESTWOOD MANAGEMENT COMPANY <br />Lloyd S. Taylor moved that the City of South Bend, by its Board of Public <br />Works and Safety, enter into an agreement with Crestwood Management Company <br />for an easement to construct a storm water retention basin on property in <br />which the Crestwood Management Company presently has an option to purchase, <br />should such option to purchase be exercised, subject to the approval of <br />an appropriation ordinance from the cumulative sewer building sinking fund <br />by the Common Council. The motion was seconded and unanimously carried, <br />and the agreement executed on behalf of the Board by Lloyd S. Taylor, President. <br />PLANS AND..SPECIFICATIONS APPROVED - DEPARTMENT -OF REDEVELOPMENT PROJECT <br />_I_NDIANA R-66, PHASE II, RETAINING WALL, CENTRAL DOWNTOWN AREA <br />Upon motion made, seconded and carried, plans and specifications submitted <br />by the Department of Redevelopment for Project Indiana R-66, Phase II A, <br />Retaining Wall, in the central downtown area, were approved by the Board. <br />
