Following discussion, it was moved, seconded and <br />unanimously carried that Resolution No. 3348, 1971, for Opening of Street, <br />be approved, upon the express condition that the City of South Bend assume <br />no responsibility for crossing protection, either erection or maintenance <br />protection, or maintenance of the crossing surface. The City Engineer <br />is directed to prepare an assessment roll showing the award of damages and <br />assessment of benefits to surrounding properties. <br />PETITION TO VACATE ALLEY - HANSEL NEIGHBORHOOD SERVICE CENTER,A NC. <br />Hansel Neighborhood Service Center, Inc., 1045 W. Washington Avenue, South <br />Bend, Indiana, files its petition to vacate the alley between Huey and Sadie <br />Streets, from the south right of way line of Linden Avenue to 97 feet south <br />of the south right of way line of Linden Avenue. Upon motion made, <br />seconded and carried, the petition is referred to the Engineering Depart- <br />ment and the Area Plan Commission, simultaneously, for study and recommenda- <br />tion to the Board. <br />COLUMBIA (COLUMBUS) COURT - VACATION TO VEHICULAR TRAFFIC <br />The Eity Attorney reports the adoption of an ordinance by the Common Council <br />of the City of South Bend, Indiana, No. 5312-71, on June 28, 1971, prohibit- <br />ing vehicular traffic on Columbia Court, from Main Street to Michigan Street. <br />AGREEMENT TO REPLACE TREES - IRELAND ROAD <br />Upon motion made, seconded and carried, the Board authorized the replacement <br />of trees to R. S. Albert, 320 E. Ireland Road, South Bend, Indiana, 46614, <br />as set forth in the following: <br />"October 18, 1971 <br />"Mr. R. S. Albert <br />320 E. Ireland Road <br />South Bend, Indiana, 46614 <br />Dear Mr. Albert: <br />"I have asked the Park Department arborist to examine the <br />row of maple trees across the front of your property at the <br />above address. He has reported that the method used to pro- <br />tect the trees from the back slope should be effective in <br />preventing damage to the trees.
