<br />HEARING ON ASSESSMENT ROLL - VACATION RESOLUTION NO. 3346, 1911 - FLOYD

<br />This being the date set, hearing was had on the assessment roll in Vacation
<br />Resolution No. 3346, 1971, for the vacation of the north -south alley between
<br />Carroll and Colukbia Street from the south right of way line of the first
<br />alley south of Bronson Street running south 102 feet to the _north property
<br />line of Lot 29, all in Denniston and Fellows Addition.
<br />Proofs of publication of notice in the South Bend Tribune and the Tri County
<br />News on September 24, October 1 and Octo er 8, 1971, were read and found to
<br />be sufficient. No remonstrators having appeared and no written remonstrances
<br />having been received, upon motion made, seconded and unanimously carried
<br />the assessment roll was approved as presented and the resolution in all
<br />things ratified and confirmed.

<br />Lloyd S. Taylor, City Engineer, files assessment roll, showing the award of
<br />damages and assessor nt of benefits, in Vacation Resolution no. 3347, 1971,
<br />for the vacation of the first east -west alley north of Huron Street from the
<br />west line of Carlis a Street west to the east line of the first north -south
<br />alley.
<br />The following property may be injuriously or beneficially affected by such
<br />vacation:
<br />Lots numbered 312 through 322 and lots numbered 340 through
<br />350, all in the Second Plat of Summit Place Addition.
<br />Total net damages - $00.00
<br />Total net benefits - $00.00
<br />Upon motion made, seconded and unanimously carried, the Board adopted said
<br />assessryemt rptt and set 9--30 A.M. on November 15, 1971, as the date for
<br />hearing all persons interested in or affected by said vacation. And the Clerk
<br />was directed to give notice of such hearing by publication in the South Bend
<br />Tribune and the Tri County News on October 22, October 29 and November 5, 1971.
<br />HEARING ON RESOLUTION NO. 3348 1971_ FOR OPENING OF STREET - NORTH SHORE
<br />WOODS ONE
<br />This being the date set, hearing was held on Resolution No. 3348, 1971, for
<br />the opening and extension of:
<br />The street known as North Shore Drive, from its existing termination
<br />point at the south railroad right of way of the St. Joseph Valley
<br />Railroad Company, now Michigan Central Railroad and/or Michigan
<br />Airline Railroad Company, Penn Central Transportation Company,
<br />lessee thereof, to the north line of such railroad right of way.
<br />Such involved opening and extension of such street situated within
<br />the limits of the city of South Bend, Indiana.
<br />Attorney Joseph A. Roper and Richard M. Hodson, representing the petitioner,
<br />North Shore Woods One, appeared before the Board. No one further appeared for
<br />or against said street opening.
<br />The President of the Board read a letter from Penn Central Company, by
<br />C. E. Defendorf, Chief Engineer, 6 Penn Center Plaza, Philadelphia,
<br />Pennsylvania, under date of October 7, 1971, reading, in part, as follows:
<br />"The railroad and highway authorities throughout the nation are
<br />discouraging establishing new grade crossings and every effort is
<br />being expended to reduce the number of existing grade crossings.
<br />Therefore, we would be very reluctant to cooperate in establishing
<br />a new crossing at North Shore Drive.
<br />"However, if public need and necessity indicate that such a crossing
<br />must be established, we would cooperate provided Penn Central was
<br />completely reimubrsed for all cost involved. This would include
<br />crossing surface, protection, alteration to communication pole if
<br />necessary and the assumption by South Bend of future maintenance expenses."
