9/27/71 " RESOLUTION NO. 33480, 1971 - FOR OPENING OF STREET "RESOLVED BY THE BOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF SOUTH BEND, INDIANA, That it is desirable to open and lay out the following: The extension of the street known as North Shore Drive, South Bend, Indiana, from its existing termination point at the south railroad right of way of the St. Joseph Valley Railroad Company, now Michigan Central Railroad and/or Michigan Airline Railroad Company, Penn Central Transportation Company, lessee thereof, to the north line of such railroad right of way. Such involved open- ing and extension of such street situated within the limits of the city of South Bend, Indiana, being described by metes and bounds as follows: A tract of land in the northeast Quarter, Section 2, Town- ship 37 north, Range 2 east, Portage Township, city of South Bend, St. Joseph County, Indiana, more particularly described as follows: Commencing at the intersection of the projected centerline of North Shore Drive with the centerline of the Penn Central Railroad, said point being 1.17 feet 0eaft of the east face of a concrete headwall; thence north 00 00 east, a distance of 50.00 feet; thence north 90000' east, a distance of 9.67 feet to the true place of beginning, said point being on the north line of said Penn Central Railroad; thence continuing on the aforesaid bearing of north 90000' east on and along said north line of the Penn Central Railroad, a distance of 81.34 feet; thence south 10027' west, a distance of 101.68 feet to the south line of said Penn Central Railroad; thence south 90000' on and along said south line, a distance of 81.34 feet; thence north 10027' east, a distance of 101.68 feet to the place of beginning; reserving, however, to such Michigan Central Rail- road and/or Michigan Airline Railroad Company and/or Penn Central Transportation Company and/or the trustees of the latter company its and/or their rights and easements in and to such affected railroad right of way. "RESOLVED FURTHER, That no property is either injuriously or beneficially affected by the adoption of th$s resolution. "Notice of this resolution shall be published on the 1st day of October and the 8th day of October, 1971, in the South Bend Tribune and the Tri County News. "This Board, at its office in Room 1308 County City Building, on the 18th day of October, 1971, at 9:30 A.M., will hear and receive remonstrances from all persons interested in or affected by these pro- ceedings.
