9/27/71 <br />" RESOLUTION NO. 33480, 1971 - FOR OPENING OF STREET <br />"RESOLVED BY THE BOARD OF PUBLIC WORKS AND SAFETY OF THE <br />CITY OF SOUTH BEND, INDIANA, That it is desirable to open and lay <br />out the following: <br />The extension of the street known as North Shore Drive, <br />South Bend, Indiana, from its existing termination point <br />at the south railroad right of way of the St. Joseph <br />Valley Railroad Company, now Michigan Central Railroad <br />and/or Michigan Airline Railroad Company, Penn Central <br />Transportation Company, lessee thereof, to the north <br />line of such railroad right of way. Such involved open- <br />ing and extension of such street situated within the limits <br />of the city of South Bend, Indiana, being described by <br />metes and bounds as follows: <br />A tract of land in the northeast Quarter, Section 2, Town- <br />ship 37 north, Range 2 east, Portage Township, city of <br />South Bend, St. Joseph County, Indiana, more particularly <br />described as follows: <br />Commencing at the intersection of the projected centerline <br />of North Shore Drive with the centerline of the Penn Central <br />Railroad, said point being 1.17 feet 0eaft of the east face of <br />a concrete headwall; thence north 00 00 east, a distance of <br />50.00 feet; thence north 90000' east, a distance of 9.67 feet <br />to the true place of beginning, said point being on the north <br />line of said Penn Central Railroad; thence continuing on the <br />aforesaid bearing of north 90000' east on and along said north <br />line of the Penn Central Railroad, a distance of 81.34 feet; <br />thence south 10027' west, a distance of 101.68 feet to the <br />south line of said Penn Central Railroad; thence south 90000' <br />on and along said south line, a distance of 81.34 feet; thence <br />north 10027' east, a distance of 101.68 feet to the place of <br />beginning; reserving, however, to such Michigan Central Rail- <br />road and/or Michigan Airline Railroad Company and/or Penn <br />Central Transportation Company and/or the trustees of the <br />latter company its and/or their rights and easements in and to <br />such affected railroad right of way. <br />"RESOLVED FURTHER, That no property is either injuriously <br />or beneficially affected by the adoption of th$s resolution. <br />"Notice of this resolution shall be published on the 1st day <br />of October and the 8th day of October, 1971, in the South Bend Tribune <br />and the Tri County News. <br />"This Board, at its office in Room 1308 County City Building, <br />on the 18th day of October, 1971, at 9:30 A.M., will hear and receive <br />remonstrances from all persons interested in or affected by these pro- <br />ceedings. <br />"Adopted this 27th day of September, 1971. <br />BOARD OF PUBLIC WORKS AND SAFETY <br />OF THE CITY OF SOUTH BEND, INDIANA <br />s/ Lloyd S.
