REGULAR MEETING <br />DECEMBER 3, 1973 <br />1 <br />1 <br />OPENING OF BIDS - CAMBRIDGE DRIVE SEWERS <br />This was the date set for receiving bids for the construction of a sewer in the <br />Crest Manor Subdivision from Miami Road to Kindig Drive, at the rear of the north <br />side of Cambridge Drive, as authorized by Improvement Resolution No. 3386, 1973. <br />The Clerk tendered proofs of publication of notice in the South Bend Tribune and <br />the Tri-County News which were found to be sufficient. The following bids were <br />opened and publicly read. <br />Bradberry Brothers <br />20061 Dice Street <br />South Bend, Indiana <br />Bid - $10,810.00 <br />H. DeWulf Mechanical Contractor <br />58600 Executive Drive <br />Mishawaka, Indiana <br />Bid - $12,467.00 <br />Dye Plumbing & Heating Co. <br />712 Madison St. <br />LaPorte, Indiana <br />Bid - $18,008.00 <br />Bid was signed by W. J. Bradberry, <br />non -collusion affidavit was in order <br />and a 5% bid bond accompanied the bid. <br />Bid was signed by Henry DeWulf, non - <br />collusion affidavit was in order and <br />a 5% bid bond accompanied the bid. <br />Bid was signed by Charles T. Dye, <br />non -collusion affidavit was in order, <br />and a 5% bid bond accompanied the bid. <br />Howell Construction Company Bid was signed by Ronald Howell, non - <br />III E. Windsor Street collusion affidavit was in order and <br />Elkhart, Indiana a 5% bid bond accompanied the bid. <br />Bid - $13,176.00. <br />Upon motion made, seconded and carried, the bids were referred to the Division <br />of Engineering for review and recommendation. <br />HEARING ON VACATION RESOLUTION NO. 3389, 1973 <br />This being the date set, hearing was held on Vacation Resolution No. 3389, 1973 for <br />the vacation of the North -South alley between Carroll and Columbia Streets, from <br />Bronson Street South. The Clerk tendered proofs of publication of notice in the <br />South Bend Tribune and the Tri-County News on November 9 and November 16, 1973 <br />which were found to be sufficient. <br />Mr. Curtis Heckaman, petitioner, was present and informed the Board that he would <br />like to withdraw his petition to vacate the alley. Upon motion made, seconded and <br />carried, the Board accepted the petitioner's request to withdraw the petition and <br />Vacation Resolution No. 3389, 1973 is rescinded. <br />HEARING ON VACATION RESOLUTION NO. 3388 1973 <br />Hearing on the Vacation Resolution for the vacation of the alley north of State Road <br />23 and West of George Avenue, being Vacation Resolution No. 330, 1973, was continued <br />until this date. Mr. William E. Voor, Sr., Attorney for the petitioner, was present <br />and said that the Board had tabled this matter in order to make a visual inspection <br />of the alley. He asked for a report on their findings. Mr. Farrand said he had <br />driven down the alley and he would agree that Mr. Isaiah Steed, owner of Lot 12, <br />would have a problem getting into his garage if this alley is vacated. Mr. Voor <br />pointed out that Mr. Steed is driving on the petitioner's property when he drives <br />along the right-of-way of the highway to gain access to this alley. Mr. Farrand <br />said he would like to check thsconstruction plans to see exactly where the state <br />right-of-way line is. Upon motion made, seconded and carried, the matter was tabled <br />until December 10, 1973. <br />
