REGULAR MEETING DECEMBER 3, 1973 1 1 OPENING OF BIDS - CAMBRIDGE DRIVE SEWERS This was the date set for receiving bids for the construction of a sewer in the Crest Manor Subdivision from Miami Road to Kindig Drive, at the rear of the north side of Cambridge Drive, as authorized by Improvement Resolution No. 3386, 1973. The Clerk tendered proofs of publication of notice in the South Bend Tribune and the Tri-County News which were found to be sufficient. The following bids were opened and publicly read. Bradberry Brothers 20061 Dice Street South Bend, Indiana Bid - $10,810.00 H. DeWulf Mechanical Contractor 58600 Executive Drive Mishawaka, Indiana Bid - $12,467.00 Dye Plumbing & Heating Co. 712 Madison St. LaPorte, Indiana Bid - $18,008.00 Bid was signed by W. J. Bradberry, non -collusion affidavit was in order and a 5% bid bond accompanied the bid. Bid was signed by Henry DeWulf, non - collusion affidavit was in order and a 5% bid bond accompanied the bid. Bid was signed by Charles T. Dye, non -collusion affidavit was in order, and a 5% bid bond accompanied the bid. Howell Construction Company Bid was signed by Ronald Howell, non - III E. Windsor Street collusion affidavit was in order and Elkhart, Indiana a 5% bid bond accompanied the bid. Bid - $13,176.00. Upon motion made, seconded and carried, the bids were referred to the Division of Engineering for review and recommendation. HEARING ON VACATION RESOLUTION NO. 3389, 1973 This being the date set, hearing was held on Vacation Resolution No. 3389, 1973 for the vacation of the North -South alley between Carroll and Columbia Streets, from Bronson Street South. The Clerk tendered proofs of publication of notice in the South Bend Tribune and the Tri-County News on November 9 and November 16, 1973 which were found to be sufficient. Mr. Curtis Heckaman, petitioner, was present and informed the Board that he would like to withdraw his petition to vacate the alley. Upon motion made, seconded and carried, the Board accepted the petitioner's request to withdraw the petition and Vacation Resolution No. 3389, 1973 is rescinded. HEARING ON VACATION RESOLUTION NO. 3388 1973 Hearing on the Vacation Resolution for the vacation of the alley north of State Road 23 and West of George Avenue, being Vacation Resolution No. 330, 1973, was continued until this date. Mr. William E. Voor, Sr., Attorney for the petitioner, was present and said that the Board had tabled this matter in order to make a visual inspection of the alley. He asked for a report on their findings. Mr. Farrand said he had driven down the alley and he would agree that Mr. Isaiah Steed, owner of Lot 12, would have a problem getting into his garage if this alley is vacated. Mr. Voor pointed out that Mr. Steed is driving on the petitioner's property when he drives along the right-of-way of the highway to gain access to this alley. Mr. Farrand said he would like to check thsconstruction plans to see exactly where the state right-of-way line is. Upon motion made, seconded and carried, the matter was tabled until December 10, 1973.
