REGULAR MEETING OCTOBER 22, 1973 <br />Attached to Mr. Roemer's memorandum was the following letter: <br />October 17, 1973 <br />City of South Bend <br />Mr. James A. Roemer <br />City Attorney <br />South Bend, Indiana <br />Dear Sir: <br />As per your discussion with our representative, Americo Lucchi, this <br />letter is written to advise you that the ecology receptacles remain <br />the sole property of V.T. Enterprises and are not for sale to any <br />private individual. This is clearly stated in our proposed use <br />agreement to the City of South Bend, paragraph;:3, article 4. Only <br />advertising is for sale on our ecology receptacles. <br />We hope this is the information you do require, and if you have any <br />further questions, please don't hesitate to contact the below signed. <br />Thanking you, I remain <br />Yours verygtruly, <br />V.T. Marrese <br />Vice President <br />Upon motion made, seconded and carried, the memorandum and letter were ordered filed. <br />LETTER TO PENN CENTRAL RAILROAD RE: REPAIR OF CROSSINGS <br />The Board received a copy of the following letter sent to the Penn Central <br />Railroad: <br />October 16, 1973 <br />Mr. W. J. English <br />Division Engineer <br />Penn Central Railroad <br />Jackson, Michigan <br />Dear Mr. English: Re: Niles Avenue Crossing <br />Complaints have been made to the Board of Public Works of this City <br />concerning the condition of the Penn Central spur line and switches <br />as it crosses Niles Avenue. The Street Commissioner has inspected <br />the site and reports that a hazardous condition exists there. <br />He is aware that an attempt was made to repair this crossing by <br />adding asphalt within the past few weeks, but the repair attempted <br />is not satisfactory. <br />It appears that the dangerous situation arises because of the switches <br />which exist in the street at the crossing site. Wood planking adjoin- <br />ing the switches has deteriorated and is rotting away leaving open holes. <br />Also, metal pieces in -connection with the switches protrude two to <br />three inches from the street surface. <br />It appears at this time that permanent repairs must be made to these <br />switches or they should be removed entirely from the crossing since <br />the switches are not now being used. <br />We request your urgent attention to this dangerous situation and ask <br />you to assume your obligation of maintenance and repair at once. <br />Sincerely, <br />s/ Robert M.
