REGULAR MEETING OCTOBER 22, 1973 Attached to Mr. Roemer's memorandum was the following letter: October 17, 1973 City of South Bend Mr. James A. Roemer City Attorney South Bend, Indiana Dear Sir: As per your discussion with our representative, Americo Lucchi, this letter is written to advise you that the ecology receptacles remain the sole property of V.T. Enterprises and are not for sale to any private individual. This is clearly stated in our proposed use agreement to the City of South Bend, paragraph;:3, article 4. Only advertising is for sale on our ecology receptacles. We hope this is the information you do require, and if you have any further questions, please don't hesitate to contact the below signed. LETTER TO PENN CENTRAL RAILROAD RE: REPAIR OF CROSSINGS The Board received a copy of the following letter sent to the Penn Central Railroad: October 16, 1973 Mr. W. J. English Division Engineer Penn Central Railroad Jackson, Michigan Dear Mr. English: Re: Niles Avenue Crossing Complaints have been made to the Board of Public Works of this City concerning the condition of the Penn Central spur line and switches as it crosses Niles Avenue. The Street Commissioner has inspected the site and reports that a hazardous condition exists there. He is aware that an attempt was made to repair this crossing by adding asphalt within the past few weeks, but the repair attempted is not satisfactory. It appears that the dangerous situation arises because of the switches which exist in the street at the crossing site. Wood planking adjoin- ing the switches has deteriorated and is rotting away leaving open holes. Also, metal pieces in -connection with the switches protrude two to three inches from the street surface. It appears at this time that permanent repairs must be made to these switches or they should be removed entirely from the crossing since the switches are not now being used. We request your urgent attention to this dangerous situation and ask you to assume your obligation of maintenance and repair at once. Sincerely, s/ Robert M.
