REGULAR MEETING JULY 2, 1973 VACATION RESOLUTION NO. 3380, 1973 RESOLVED BY THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND, INDIANA, That it is desirable to vacate the following: North -South alley between Sunnyside Avenue and Twyckenham Avenue from the south right of way line -of East Wayne Street south to the north right of way line of the East-West alley between East Wayne Street south and Sunnymede Avenue situated between Lots 165 and 165 in Sunnymede 1st Addition. Reserving the rights and easements of all Utilities and the Municipal City of South Bend, Indiana, to construct and maintain any facilities, including, but not limited to, the following: electric, telephone, gas, water, sewer surface water control structures and ditches, within the vacated right of way, unless such rights are released by the individual Utilities. The following property may be injurioysl,y or beneficially affected by such vacation: Lots 164 and 165 in Sunnymede 1st Addition. e-� p Notice of this Resolution shall be published on the 6th & 13th day of July, 1973 Qin the South Bend Tribune and in the Tri-County News. This Board, at its office, on the 30th day of July, 1973 at 9:30 o'clock A.M. will hear and receive remonstrances from all persons interested in or affected by these proceedings. Farrand, City Engineer, files an Assessment Roll showing the award of damages and the assessment of benefits in Vacation Resolution No. 3378, 1973 for the vacation of the Alley north of Western Avenue between Scott Street and Taylor Street. Beginning on the north right of way line of Western Avenue at a point 115.5' West of Taylor Street thence running north 124' thence west 130' thence south 124' to the north right of way of Western Avenue, thence East 121, thence north 1121, thence east 1061, thence south 112' to the north right of way line of Western Avenue thence east 12' to the point of beginning. The following property may be injuriously or beneficially affected by such vacation: Bank Out Lot 54 and 55. Total net benefits $0.00 Total new damages $0.00 Upon motion made, seconded and carried, the Board adopted said Assessment Roll and set August 6, 1973 at 9:30 a.m., Room 1308 County -City Building, South Bend, Indiana, as the date and place for hearing all persons interested in or affected by such vacation.
