REGULAR MEETING <br />MAY 29, 1973 <br />ADOPTION OF VACATION RESOLUTION NO. 3379, 1973 <br />Upon motion made, seconded and carried, the,following resolut_i.on_was adopted. <br />VACATION RESOLUTION NO. 3379, 1973 <br />RESOLVED BY THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND, INDIANA, That <br />it is desirable to vacate the following: <br />The first East-West alley South of Prairie Avenue from Gertrude <br />Street West 181.25' to the East right of way line of the first <br />North -South alley West of Gertrude Street. <br />Reserving the rights and easements of all Utilities and the Municipal City of <br />South Bend, Indiana, toconstruct and maintain any facilities, including, but <br />not limited to, the following: electric, telephone, gas, water, sewer, surface <br />water control structures and ditches, within the vacated right of way, unless <br />such rights are released by the individual Utilities. <br />The following property may be injuriously or beneficially affected by such <br />vacation: Lots 21, 22 and 23 of Romig's lst Addition and Lots 24 and 25 <br />Unplotted. <br />Notice of this Resolution shall be published on the 1st and the 8th day of June, <br />1973 in the South Bend Tribune and the Tri-County News. <br />This Board at its office on the 25th day of June, 1973 at 9:30 o'clock A.M. <br />will hear and receive remonstrances from all persons interested in or affected <br />by these proceedings. <br />Adopted this 29th day of May, 1973. <br />BOARD OF PUBLIC WORKS <br />s/ William J. Richardson <br />s/ James R. .Seitz <br />ATTEST: <br />s/ Patricia DeClercq, Clerk <br />AUTHORIZATION FOR NEGOTIATION AND PREPARATION OF A CONTRACT FOR A STUDY TO <br />DETERMINE THE NEED FOR OFF-STREET PARKING FACILITIES <br />Upon motion made, seconded and carried, the Board authorized the negotiation <br />and preparation of a contract between the City and Wilbur Smith and Associates <br />for an engineering study to determine the need for off-street parking facilities <br />and the location of such facilities in the immediate central business district, <br />with the stipulation that this agreement in no way authorized any expenditures <br />nor does it authorize execution of this contract. The Board raises questions in <br />regard to the actual need for this study which must be answered prior to their <br />giving approval for the expenditures or the execution of the contract and requests <br />that the Department of Redevelopment provide this justification. <br />LETTER FROM COMMON COUNCIL REGARDING UTILITY CUTS IN PAVEMENT <br />The Board received a letter from City Clerk Irene Gammon expressing the <br />Common Council's concern about utility companies cutting into newly paved <br />streets. The letter requested that this be discussed at a Board meeting and <br />that consideration be given to coordinating improvement and installation of <br />pavement with utility companies in advance to avoid such cutting. Mr. Roemer <br />explained to the Board members -that this question was raised at the last <br />Common Council meeting in a public hearing and he suggested that a letter be <br />written to the Board of Works. Mr. Richardson said that thousands of hours.are <br />devoted to coordination of projects with utility companies. He said no one can <br />guarantee that there will be no gas or water leaks and when such leaks occur, <br />they must be repaired immediately. Mr. Richardson said that he would attend <br />the May 29, 1973 Common Council meeting and give the Council -members a public <br />answer at that time. <br />
