253 <br />REGULAR MEETING MAY 29, 1973 <br />Mr. Richardson made a motion that all bids be rejected and that the Board <br />re -advertise for bids to be received on June 11, 1973. The motion was seconded <br />and carried. Mr. Richardson asked Mr. Stanley Przybylinski, Manager of the <br />Municipal Services Facility, to see that the bidders are all told what kind of <br />system the City wants and that they.use the proper froms 96 and 96A to bid. <br />HEARING ON VACATION RESOLUTION NO. 3377, 1973 <br />This being the date set, hearing was held on Vacation Resolution No. 3377, 1973 <br />for the vacation of the alley running south from Madison Street to the first <br />East-West alley between St. Peter and Notre Dame Avenue. <br />The Clerk tendered proofs of publication of notice in the South Bend Tribune <br />and the Tri-County News on the 4th and the llth day of May, 1973. <br />No remonstrators having appeared and no written remonstrances having been filed, <br />upon motion made, seconded and carried, the Board ratified and confirmed Vacation <br />Resolution No. 3376, 1973 and said alley is vacated. <br />The City Engineer is directed to prepare an assessment roll showing the award of <br />e-1 damages and the assessment of benefits to the surrounding properties. <br />O <br />ADOPTION OF VACATION RESOLUTION NO. 3378, 1973 <br />Q <br />Upon motion made, seconded and carried, the following resolution was adopted: <br />VACATION RESOLUTION NO. 3378 1973 <br />RESOLVED BY THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND, INDIANA, That <br />it is desirable to vacate the following: <br />Alley north of Western Avenue between Scott Street and Taylor Street, <br />Beginning on the north right of way line of Western Avenue at a point <br />115.5' West of Taylor Street thence running north 124' thence west <br />130' thence south 124' to.the north right of way of Western Avenue, <br />thence East 121, thence north 1121, thence east 1061, thence south 112' <br />to the point of beginning. . <br />This alley is situated in Bank Out Lot 55 of the First Addition of Out <br />Lots by the State Bank of Indiana. <br />Reserving the rights and easements of all Utilities and the Municipal City of <br />South Bend, Indiana, to construct and maintain any facilities, including, but <br />not limited to, the following: electric, telephone, gas, water, sewer, surface <br />water control structures and ditches, within the vacated right of way, unless <br />such rights are released by the individual Utilities. <br />The following property may be injuriously or beneficially affected by such <br />vacation: Bank Out Lot 54 and 55. <br />Notice of this Resolution shall be published on the 1st and the 8th day of June, <br />1973, in the South Bend Tribune and in the Tri-County News. <br />This Board, at its office, on the 25th day of June, 1973, at 9:30 o'clock A.M. <br />will hear and receive remonstrances from all persons interested in or affected by <br />these proceedings. <br />Adopted this 29th day of May, 1973. <br />BOARD OF PUBLIC WORKS <br />s/ William J.
