234 <br />REGULAR MEETING <br />MAY 14, 1973 <br />Also, a part of -the West half of the Northeast Quarter and the East <br />half of the Northwest Quarter of Section No. 14, Township No. 37 North, <br />Range No. 2 East, which part is bounded by a line running as follows, <br />viz: Beginning on the South line of Sample Street in the City of South <br />Bend at a point 220 feet West of the West line of Catalpa Avenue <br />(formerly Herbert Street) in said City; thence running South parallel with <br />Catalpa Avenue a distance of 591.691 Feet to the South line of Garst <br />Street, projected West; thence West 261.512 feet; thence North 591.692 <br />feet to the South line of Sample Street; thence East on said South line <br />361.512 feet to the place of beginning, all now within and a part of <br />the City of South Bend. <br />That the real estate hereinabove described covers the tract lying <br />North and West of Kerr Street in the City of South Bend, and is <br />indicated in red on the copy of the Plat Record of the subject real <br />estate which is attached hereto, is made a part hereof and is identified <br />as- EXHIBIT "A". <br />2. That the petitioner herein, Curtis L. Crofoot, is also the owner of the <br />following described real estate situated in the City of South Bend, St. <br />St. Joseph County, Indiana, to -wit: <br />Parcel Numbered Five (5) and the West Half (2) of the alley lying East <br />of and adjacent to Parcel 5 between Garst and Kerr Streets in the Inner <br />Belt Industrial Park, a Subdivision in the Southeast and Southwest Quarter <br />(4) of Section 11, and the Northeast Quarter (4) of Section 14, all in <br />Township 37 North, Range 2 East of the Second Principal Meridian, City of <br />South Bend, Indiana, the Plat of which is recorded in Plat Book 21, Page 1, <br />in the Office of the Recorder of St. Joseph County, EXCEPTING therefrom <br />the East 211 feet heretofore conveyed to Marquis L. Lake and, Doris E. Lake, <br />husband and wife, in Deed Record 700, Page 364. <br />That the real estate herein described lies West of Catalpa Avenue and <br />South of Kerr Street in the City of South Bend, and is indicated in blue <br />on the copy of the Plat Record of the subject real estate,which is <br />attached hereto, is made a part hereof and is identified as Exhibit "A". <br />3. That said Kerr Street as it proceeds in a Westerly direction from <br />Catalpa Avenue in the City of South Bend, is bordered by real estate <br />owned by your petitioner on the North, West and South; that the con- <br />tinuation of the described portion of Kerr Street as a public street <br />is not in the interests of the public and said portion of Kerr Street <br />should be vacated. <br />WHEREFORE, your petitioner prays that this Honorable Board of Public Works <br />adopt a resolution vacating the West 194.74 feet of Kerr Street which runs North <br />of and parallel to the real estate of your petitioner described and designated <br />in blue on EXHIBIT "A" hereto, to cause notice of such resolution to be published <br />in the manner provided by statute; and thereafter to take final action confirm- <br />ing such resolution. <br />CURTIS L. Nafe, <br />his Attorney <br />605 JMS Building <br />South Bend, Indiana <br />Upon motion made, seconded and carried, the petition was referred to the <br />Division of Engineering for preliminary investigation and report to the <br />Board. <br />RECOMMENDATION ON PETITION TO VACATE ALLEYS SOUTH OF CALVERT AND WEST OF MAIN <br />The Boadd received a recommendation from the Division of Engineering that they <br />have no objection to proceeding with the vacation of the alleys south..of <br />Calvert and West of Main Street. Upon motion made, seconded and carried, the <br />Board referred the petition to the Area Plan Commission for their investigation <br />and report. <br />
