2/12/73 <br />ADOPTION OF VACATION RESOLUTION - ALLEY EAST OF MICHIGAN BETWEEN WASHINGTON <br />AND JEFFERSON BLVD. <br />Upon motion made, seconded= -:and carried the following resolution was adopted: <br />VACATION RESOLUTION NO. 3375-1973 <br />RESOLVED BY THE BOARD OF PUBLIC WORKS OP THE CITY OF SOUTH BEND, INDIANA* That <br />it is desirable to vacate the following: <br />Fourteen (14) foot alley, sometimes known as Hibbard Court, between Washington <br />Street and Jefferson Boulevard, running East from Michigan Street to the West <br />line of the North -South alley between Michigan and St. Joseph Streets, a distance <br />of one hundred sixty five (165) feet. <br />Reserving the rights and easements of all Utilities and"the Municipal City of <br />South Bend, Indiana, to construct and maintain any facilities, including, but not <br />limited to, the following electric, telephone, gas, water, sewer, surface water <br />control structures and ditches, within the vacated right of way, unless such <br />rights are released by the individual Utilities. <br />O The following property may be injuriously or beneficially affected by such <br />vacation: <br />Lots 37, 38, 39, 40, 41, 42, 43, 44, 45, and 46 of the Original Plat of South <br />Bend, Indiana. <br />Notice of this Resolution shall be published on the 16th and 23rd day of February, <br />1973 in the South Bend Tribune and in the Tri-County News. <br />This Board, at its office, on the 5th day of March, 1973, at 9:30 a.m. will hear <br />and receive remonstrances from all persons interested in or affected by these <br />proceedings. <br />Adopted this 12th day of February, 1973. <br />BOARD OF PUBLIC WORKS <br />s/ William J. Barcome <br />ATTEST: <br />s/ Patricia DeClercq, Clerk <br />REQUEST FOR PARADE - AVALON GROTTO MIDWEST GROTTO CONVENTION <br />Mr. Homer Cuthbertson, representing the Avalon Grotto, appeared before the Board <br />and asked for permission to hold a parade at 1:30 p.m. on October 5, 1974 in <br />connection with the Midwest Grotto Convention to be held in South Bend. The <br />Board referred the matter to Mr. Clem Hazinski, Director of the Bureau of Traffic <br />and Lighting and asked that he contact Mr. Cuthbertson in regard to this request. <br />MEMO FROM BUREAU OF ENGINEERING RE: ALLEY VACATION EAST OF MICHIGAN BETWEEN <br />MADISON AND MARION <br />The Board received a report from the Bureau of Administration and Design that <br />there were no objections to the vacation of the alley East of Michigan Street, <br />between Madison and Marion. Upon motion made, seconded and carried, the Board <br />referred the petition to the Area Plan Commission for their recommendation. <br />MEMO FROM BUREAU OF ENGINEERING RE: ALLEY VACATION NORTH OF WESTERN BETWEEN <br />SCOTT AND TAYLOR <br />In response to a letter from Rev. Richard Kennedy, C.S.C., St. Patriek's Church, <br />regarding vacation of the alley North of Western between Scott and Taylor Streets, <br />the Bureau of Administration and Design reported that there were no objections <br />to the vacation of the alley. The Clerk was instructed to write Father Kennedy <br />that action on the vacation would proceed upon receipt of the petition, the fee <br />and -the names of the affected property owners. <br />
