REGULAR MEETING FEBRUARY 12,1973 <br />A regular meeting of the Board of Public Works convened at 9:30 a.m. on <br />Monday, February 12, 1973 with all members present. Minutes of the last <br />meeting were reviewed and approved. <br />AWARDING OF BIDS - STREET SWEEPERS <br />The Board received a recommendation from William J. Richardson, Director of Public <br />Works, that the bid of Ries Equipment Company, Indianapolis, for four street <br />sweepers at a net bid of $79,960 be accepted, subject to approval by the Common <br />Council. Upon motion made, seconded and carried, the Board accepted the recom- <br />mendation and awarded the bid to Ries Equipment Company. <br />AREA PLAN COMMISSION RECOMMENDATION - VACATION OF ALLEY BETWEEN ROGER AND BERTRAND <br />A favorable recommendation was received from the Area Plan Commission in regard to <br />the petition to vacate the first east -west alley between Meade and Fremont, from <br />Fremont Street west to the north -south alley between Roger Street and Bertrand Street. <br />Upon motion made, seconded and carried, the Board ordered the recommendation filed <br />and referred the petition to the Bureau of Engineering for preparation of the <br />Vacation Resolution. <br />AREA PLAN COMMISSION RECOMMENDATION - VACATION OF ALLEYS KNOWN AS HIBBARD COURT <br />A favorable recommendation was received from the Area Plan Commission in regard to <br />the petitions to vacate two alleys known as Hibbard Court, running East and West <br />of Michigan Street, between Michigan and Main and Michigan and St. Joseph Streets, <br />in the Downtown Renewal Project, Indiana R-66. Upon motion made, seconded and carried the <br />Board accepted the recommendation and ordered it filed. <br />ADOPTION OF VACATION RESOLUTION - ALLEY WEST OF MICHIGAN BETWEEN MICHIGAN AND MAIN <br />Upon motion made, seconded and carried, the following resolution was adopted: <br />VACATION RESOLUTION NO. 3374-1973 <br />RESOLVED BY THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND, INDIANA, That it <br />is desirable to vacate the following: <br />Fourteen (14) foot alley, sometimes known as Hibbard Court, between <br />Washington Street and Jefferson Boulevard, running West from Michigan <br />Street to the East line of the North -South alley between Michigan and <br />Main Streets, a distance of one hundred sixty-five (165) feet. <br />Reserving the rights and easements of all Utilities and the Municipal City of South <br />Bend, Indiana, to construct and maintain any facilities, including, but not limited <br />to, the following: electric, telephone, gas, water, sewer, surface water control <br />structures and ditches, within the vacated right of way, unless such rights are <br />released by the individual utilities. <br />The following property may be injuriously or beneficially affected by such vacation: <br />Lots 25, 26, 27, 28, 29, 30, 31, 32, 33, 34, 35 and 36 of the Original Plat of <br />South Bend, Indiana. <br />Notice of this Resolution shall be published on the 16th and 23rd day of February, <br />1973 in the South Bend Tribune and in the Tri-County News. <br />This Board, at its office, on the 5th day of March, 1973, at 9:30 o'clock A.M., will <br />hear and receive remonstrances from all persons interested in or affected by these <br />proceedings. <br />Adopted this 12th day of February, 1973. <br />BOARD OF PUBLIC WORKS <br />s/ William J.
