Bids shall be submitted in a sealed envelope on forms sup- <br />plied by the Board of Works to the Building Commissioner <br />in Room #1308, County -City Building on or before 9:30 A.M. <br />on Monday at which time and place said <br />Board of Works shall open atl bids and award contract to <br />the best bidder. <br />4. The owners shall pay all costs incurred through the award- <br />ing and through the completion of the terms of the -contract. <br />Upon failure of the owners to pay such costs, the Building <br />Commissioner, shall, by paying all costs, secure all liens <br />which shall have been filed against the property. <br />D. FAILURE TO PERFORM <br />1. Contractor agrees that failure to comply with Section B <br />"Progress and Completion" wIll result i'n the Board of <br />Public Works and Safety of the City of South Bend, im- <br />posing liquidated damages in an amount of $10,00 per day <br />for each day the demolition contract remains incompleted. <br />2. Payment of the contract prices will be made to the Con- <br />tractor after setting off against the award price the <br />liquated damages said Contractor incurs, and any ex- <br />penses necessarily incurred in the administration of the <br />contract. <br />3. Failure to perform in the manner prescribed in this agree- <br />ment will result in notification of such non-performance <br />to the Board of Public Works and Safety. <br />PART II <br />PUBLIC WORKS DEMOLITION CONTRACT <br />THIS AGREEMENT, made and entered into this day of <br />19 by and between <br />hereinafter called <br />the Contractor & the Board of Public Works and Safety herin called the <br />"Board". <br />WITNESSETH: That the Contractor covenants and agrees to demolish the <br />following, as fully set out in the Notice to Contractors, Standard <br />Specifications, Special Provisions, and Bid Proposal for: <br />PROJECT NO. <br />DESCRIPTION <br />STRUCTURE <br />COMPLETION DATE See "Notice to Proceed'! <br />The price for this demolition was received and accepted by the Board <br />on the day of 19 <br />The Contractor further agrees to guarantee the materials and workman- <br />ship against any defects for a period of (1) year from the date of final <br />acceptance of this improvement by the Board. Upon written notice from the <br />Board, the Contractor will remove and replace with no cost to the <br />Board, any defective workmanship or materials which may appear within <br />the 1 year period and pay for any damage to other property caused by <br />this defect. <br />The Contractor further agrees to notify the Building Official when this <br />demolition is completed. This notification shall be in the form of a <br />written notice, signed by the Contractor. Upon final acceptance of the <br />work by the Building Official, the Contractors final payment will be <br />presented to the Board. <br />
