Bids shall be submitted in a sealed envelope on forms sup- plied by the Board of Works to the Building Commissioner in Room #1308, County -City Building on or before 9:30 A.M. on Monday at which time and place said Board of Works shall open atl bids and award contract to the best bidder. 4. The owners shall pay all costs incurred through the award- ing and through the completion of the terms of the -contract. Upon failure of the owners to pay such costs, the Building Commissioner, shall, by paying all costs, secure all liens which shall have been filed against the property. D. FAILURE TO PERFORM 1. Contractor agrees that failure to comply with Section B "Progress and Completion" wIll result i'n the Board of Public Works and Safety of the City of South Bend, im- posing liquidated damages in an amount of $10,00 per day for each day the demolition contract remains incompleted. 2. Payment of the contract prices will be made to the Con- tractor after setting off against the award price the liquated damages said Contractor incurs, and any ex- penses necessarily incurred in the administration of the contract. 3. Failure to perform in the manner prescribed in this agree- ment will result in notification of such non-performance to the Board of Public Works and Safety. PART II PUBLIC WORKS DEMOLITION CONTRACT THIS AGREEMENT, made and entered into this day of 19 by and between hereinafter called the Contractor & the Board of Public Works and Safety herin called the "Board". WITNESSETH: That the Contractor covenants and agrees to demolish the following, as fully set out in the Notice to Contractors, Standard Specifications, Special Provisions, and Bid Proposal for: PROJECT NO. DESCRIPTION STRUCTURE COMPLETION DATE See "Notice to Proceed'! The price for this demolition was received and accepted by the Board on the day of 19 The Contractor further agrees to guarantee the materials and workman- ship against any defects for a period of (1) year from the date of final acceptance of this improvement by the Board. Upon written notice from the Board, the Contractor will remove and replace with no cost to the Board, any defective workmanship or materials which may appear within the 1 year period and pay for any damage to other property caused by this defect. The Contractor further agrees to notify the Building Official when this demolition is completed. This notification shall be in the form of a written notice, signed by the Contractor. Upon final acceptance of the work by the Building Official, the Contractors final payment will be presented to the Board.
