A permit <br />was issued however some time ago to create access to <br />a parking lot atothe south side of the building and at <br />no time have I observed this facility to capacity. <br />Parking of vehicles as described in the letter from <br />Council President Parent is prohibited because of the manner <br />in which access to the setback is attained by motorists. <br />Such prohibition is further described in the Municipal: Code <br />the City of South Bend in Sec.' 20-72, 20-82, Sec. 20-83 and <br />These are violations of a city ordinance that can easily and <br />readily be enforced by alert police department action. <br />s/ Clem F. Hazinski <br />Upon motion made, seconded and carried, the report was referred <br />to the Chief of Police with the request that the complaint be <br />investigated and the Board be advised of actions taken. <br />ADOPTION OF RESJLUTION NO. 16 <br />Upon motion made, seconded and carried, the following rewolution <br />was adopted: <br />RESOLUTION NO. 16 <br />of <br />Sec. 20-86. <br />WHEREAS, the Board of Public Works has found it necessary in the <br />best interests of the public safety and welfare to construct <br />certain street improvements on Westmoor Street between <br />Sheridan Avenue and Bendix Drive, and <br />WHEREAS, the improvements to the aforesaid street are compatible <br />with the Urban Area Transportation Study, and <br />WHEREAS, the costs for these improvements are to be pro -rated <br />between Local Road and Street Funds and the Cumulative <br />Capital Improvement Funds, and <br />WHEREAS, the Board of Public Works has the authority to make such <br />improvements as provided by the Acts of the General <br />Assembly, (I.C. 18-1-6-15 and others). <br />THEREFORE, BE IT RESOLVED, that the Board of Public Works orders <br />the Department of Public Works to prepare the plans, specifications <br />and cost estimates, secure the necessary right-of-way, easements,' <br />permits and appropriations, and to seek bids for and construct the <br />improvements on Westmoor Street between Sheridan Avenue and Bendix <br />Drive. <br />BOARD OF PUBLIC WORDS <br />s/ Rollin E.
