U <br />REGULAR MEETING MARCH 3, 1975' <br />recommended favorably by a unanimous vote of the Area Plan Commission., <br />with Mr. Farrand abstaining. There have been no remonstrances or <br />objections filed against the petition. Mr. Bancroft and Mr. Hoffman <br />then displayed a.map and photographs of the area. Mr. Hoffman <br />indicated that they plan to open Columbia Street at a point where it <br />is not now open, because of the creek, so that the people involved <br />will have a way to get in and out. They are not making dead end <br />streets out of any'of'these streets. Mr. & Mrs. C.,0. Madden, 320 <br />E. Donald Street, were present and asked if the street would be paved. <br />Mr. Hoffman said there is a 20 foot dedicated'street and they will <br />maintain it to match existing streets, probably with a gravel <br />surface. Mr. Decker, Street Commissioner, was present and said his <br />department had planned to hard surface the street but were not aware <br />of the plans for this area. He asked when the work would be completed. <br />Mr. Hoffman said they hope to begin construction in Marchand be <br />done in the summer.Mr. Decker said, if this timetable was followed, <br />he would have a hard surface on the street this year. Mr. Hoffman <br />said there would be a fence installed at the property lines and <br />there would be no access to these streets from the parking lot. <br />© Mr. & Mrs. Andrew Dunn, 302 E. Fox Street, were present but they noted <br />that their question had already been answered. There was no one else <br />present to speak on the vacation. Upon motion made, seconded and <br />carried, the Board ratified and confirmed Vacation Resolution No. <br />W 3409, 1975 and the portions of Donald and Fox Streets from Columbia East <br />to Fellowa and the first east -west alley south of Bowman, between Fellows <br />and Rush and the north -south alley between Fellows and Push Streets from <br />Bowman to the aforesaid east -west alley and a portion of Push Street <br />south from Bowman to the first east -west alley are now vacated.' The <br />City Engineer is directed to prepare an Assessment Roll showing the <br />award of damages and the assessment of benefits to the surrounding <br />properties. <br />PUBLIC HEARING -VACATION RESOLUTION NO. 3410, 1975 <br />This being the date set, hearing was held on Vacation Resolution No. <br />3410, 1975 for the vacation of the east -west alley between Marion <br />and Madison Street, running east from the first north -south alley east <br />of Michigan Street to the vacated St. Joseph Street, City of South Bend. <br />The Clerk tendered proofs of publication of notice in the South Bend <br />Tribune and the Tri-County News which were found to be:.sufficient. <br />Mr. John Obenchain, Attorney for the petitioners, the Milton Home, <br />was present. Mr. Obenchain said this is a stip of land which was <br />taken off Lot 132 and which is landlocked by reason of the new McDonald's <br />Restaurant. The Milton Home has purchased the house on the east Half <br />of Lot 130 and 131 so there will be no one affected by the vacation: <br />lyo _remons.trato.r.s .,having. appeared -and no written. remonstrances l.being .fildd, <br />Vacation Resolution No. 3410, 1975 was"ratified and confirmed and the <br />east -west alley between Marion and Madison Street, running east from <br />the first north -south alley east of Michigan Street to the vacated <br />St. Joseph Street, City of South Bend is vacated. The City Engineer <br />is directed to prepare an Assessment Roll showing the award of damages <br />and the assessment of benefits to the surrounding properties. <br />CHANGE ORDERS APPROVED - FIREI.STATION NO. 4 <br />Change Orders 1, 2, 3, 4 and 6 for the construction of Fire Station <br />No. 4 were submitted'to the Board by E. R. Bauer: The claims for <br />the Change Orders have been approved by the Board. The Change Orders <br />make the revised amount of the contract $206,385,,00. Upon motion <br />made, seconded and carried, the Change Orders were approved. <br />ADOPTION OF VACATION RESOLUTION -NO. 3414, 1975_- ASSOCIATES BANCORP <br />Upon motion made, seconded and carried, the following resolution <br />was adopted: <br />
