f: r <br />REGULAR MEETING <br />NOVEMBER 18, 1974 <br />RECOMMENDATION FOR ACCEPTANCE - TOPICS PROJECT T6000(7) <br />The Board received a report of inspection and a recommendation to <br />the Indiana State Highway Commission that Topics Project T6000(7) <br />the McKinley, Hickory, Logan Project, be accepted. Upon motion <br />made, seconded and carried, the report and recommendation were <br />approved. <br />APPROVAL OF CONTRACT AND PERFORMANCE BOND - MIAMI-RIDGEDALE INTERSECTION <br />The Construction Contract and Performance Bond with Morse Electric <br />Company for the Miami-Ridgedale intersection were presented to the <br />Board. Upon motion made, seconded and carried, the contract was <br />signed and the performance bond was approved. <br />RESOLUTION ADOPTED RE: ACCEPTANCE OF U. S. 20 BY CITY <br />The Board received a letter from the Indiana State Highway Commission <br />informing the City that when the U. S. 20 Bypass has been completed, <br />portions of U. S. 20 in the City will be turned over to the City of <br />South Bend and requesting that a resolution accepting this be <br />approved. Upon motion made, seconded and carried, the following <br />resolution was adopted: <br />RESOLUTION NO. 19, 1974 <br />RESOLUTION CONCURRING IN THE FUTURE CONVEYANCE TO LOCAL CONTROL OF <br />PORTIONS OF: U. S. 20 (Lincolnway West) between intersection with <br />U. S. 20 bypass northwest of South Bend and then <br />easterly to the St. Joseph County -Elkhart County Line. <br />WHEREAS, existing state statutes provide that the line or.actula <br />location of a State Highway may deviate from the location of the public <br />highway as actually traveled at such time such public highway was <br />designated as a State Highway as may be deemed expedient by the State <br />Highway Commission, in order to shorten distance, eliminate steep <br />grades or sharp turns, widen narrow portions, or otherwise promote <br />public convenience and safety; and <br />WHEREAS, the Indiana State Highway Commission proposes to reconstruct <br />the above noted segment of an existing State Highway and certain <br />portions of the new facility may be on a new location removed from the <br />present roadway. In such event, the State Highway Commission may <br />designate that those portions of the existing roadway shall no longer <br />be considered as a State Highway, and the same shall be conveyed to <br />local jurisdiction; and <br />WHEREAS, the Indiana State Highway Commission, as an established <br />policy and practice will place such portions of raodway, which are to <br />be conveyed to local control, in a reasonable state of maintenance <br />compatible with anticipated usage as determined by the State Highway <br />Commission; now <br />THEREFORE, the City of South Bend does hereby agree to accept the <br />conveyance of portions of the existing roadway within the -geographical <br />limits of our jurisdiction into our maintained system of streets <br />or roads upon completion of the construction of the new state highway <br />facility, and notification of formal conveyance of the Indiana State <br />Highway Commission. <br />Dated this 18th day of November, 1974. <br />s/ Rollin E.
