RECOMMENDATIONS FOR RIVER BEND -PLAZA ACTIVITIES APPROVED The following recommendations for activities on River Bend Plaza were, upon motion made, seconded and carried, approved by the Board: TO: BOARD OF PUBLIC WORKS FROM: DEPARTMENT OF LAW RE: RIVER BEND PLAZA ACTIVITIES On August 30, 1974, a meeting was held with Mr. James A. Roemer, Patricia DeClercq, Louis Wilcox and Kathleen Cekanski to discuss specific policies relating to activities on the River Bend Plaza. Mr. Ralph Muszynski, Insurance Agent for the City, later discussed the topics under consideration. Having come to a general consensus, we, therefore, make the following recommendations to the Board for your consideration. Charitable, Religious Volunteer -Type Organizations. Charitable, religious, or volunteer -type organizations who wish to display their items on the Plaza should secure the proper.license in the name of the group or organization. Thus, individual a -,,licenses of each member of such groups should not be required. Items created by the individual himself, not being mass produced, would fall within this category. It is further recommended that insurance not be required of such organizations. We recommend that such groups not be permitted to charge admission fees for their displays, performances, or exhibits and that they submit in writing along with their River Bend Plaza application, evidence that they are, in fact, a charitable, religious or volunteer -type organization. Registration with the Charitable Solicitations Commission, forinstance, would serve as evidence that such a group is a not -for -profit organization. t is further advised that such groups not be permitted to solicit through an audience during such a show or performance. These guidelines are made in the interest of encouraging more artist - type groups, craft groups, singing groups, etc. to using the Plaza area for their shows. Experimental Farmer's Market Day. We recommend, on an experimental basis, that if the "Farmer's Market" idea of selling food items on the Plaza be pursued, the following guidelines be adopted: 1. One day a week basis (7:00 a.m.-7:00 p.m.) 2. A special "Farmer's Market" license be required of each vendor for that day ($1.00). 3. Location: Supergraphic area 4. Clean-up be coordinated by the River Bend Plaza Office. 5. Insurance policy adding the City of South Bend named as an additional insured by required. Car Displays A map should be submitted to the Board of Public Works along with the River Bend Plaza application. The City of South Bend should also be added as an additionally -named insured on each car dealer's insurance policy. Such activities are recommended on a display and not for sales activity. In the hope of furthering "people -type activity" on the Plaza we recommend adoption of these guidelines. PROJECT COMPLETION AFFIDAVIT - BURNETT INDUSTRIAL PARK A Project Completion Affidavit and Performance Bond for the Burnett Industrial Park were submitted to the Board. Mr. Farrand noted that the Affidavit was executed by the Sollitt Construction Company and the Performance Bond was in the name of Burnett. Upon motion made, seconded and carried, the Completion Affidavit was referred to the Legal Department for review.
