RECOMMENDATIONS FOR RIVER BEND -PLAZA ACTIVITIES APPROVED <br />The following recommendations for activities on River Bend Plaza <br />were, upon motion made, seconded and carried, approved by the Board: <br />TO: BOARD OF PUBLIC WORKS <br />FROM: DEPARTMENT OF LAW <br />RE: RIVER BEND PLAZA ACTIVITIES <br />On August 30, 1974, a meeting was held with Mr. James A. Roemer, <br />Patricia DeClercq, Louis Wilcox and Kathleen Cekanski to discuss <br />specific policies relating to activities on the River Bend Plaza. <br />Mr. Ralph Muszynski, Insurance Agent for the City, later discussed <br />the topics under consideration. <br />Having come to a general consensus, we, therefore, make the following <br />recommendations to the Board for your consideration. <br />Charitable, Religious Volunteer -Type Organizations. <br />Charitable, religious, or volunteer -type organizations who wish to <br />display their items on the Plaza should secure the proper.license <br />in the name of the group or organization. Thus, individual <br />a -,,licenses of each member of such groups should not be required. Items <br />created by the individual himself, not being mass produced, would <br />fall within this category. It is further recommended that insurance <br />not be required of such organizations. <br />We recommend that such groups not be permitted to charge admission fees <br />for their displays, performances, or exhibits and that they submit <br />in writing along with their River Bend Plaza application, evidence that <br />they are, in fact, a charitable, religious or volunteer -type organization. <br />Registration with the Charitable Solicitations Commission, forinstance, <br />would serve as evidence that such a group is a not -for -profit organization. <br />t is further advised that such groups not be permitted to solicit through <br />an audience during such a show or performance. <br />These guidelines are made in the interest of encouraging more artist - <br />type groups, craft groups, singing groups, etc. to using the Plaza <br />area for their shows. <br />Experimental Farmer's Market Day. <br />We recommend, on an experimental basis, that if the "Farmer's Market" <br />idea of selling food items on the Plaza be pursued, the following <br />guidelines be adopted: <br />1. One day a week basis (7:00 a.m.-7:00 p.m.) <br />2. A special "Farmer's Market" license be required <br />of each vendor for that day ($1.00). <br />3. Location: Supergraphic area <br />4. Clean-up be coordinated by the River Bend Plaza Office. <br />5. Insurance policy adding the City of South Bend named <br />as an additional insured by required. <br />Car Displays <br />A map should be submitted to the Board of Public Works along with the <br />River Bend Plaza application. The City of South Bend should also be <br />added as an additionally -named insured on each car dealer's insurance <br />policy. Such activities are recommended on a display and not for <br />sales activity. <br />In the hope of furthering "people -type activity" on the Plaza <br />we recommend adoption of these guidelines. <br />PROJECT COMPLETION AFFIDAVIT - BURNETT INDUSTRIAL PARK <br />A Project Completion Affidavit and Performance Bond for the Burnett <br />Industrial Park were submitted to the Board. Mr. Farrand noted that <br />the Affidavit was executed by the Sollitt Construction Company and <br />the Performance Bond was in the name of Burnett. Upon motion made, <br />seconded and carried, the Completion Affidavit was referred to the <br />Legal Department for review. <br />
