REGULAR MEETING <br />SEPTEMBER 27, 1976 <br />contract with the South .Bend-.Mishawaka.Area.Chamber of ,Commerce <br />is a service agreement whereby they will negotiate on the job <br />training contracts with private and public employers for CETA <br />clients. This is in the amount of $150,094. Upon motion made <br />by Mr. Mullen, seconded by Mr. Brunner and carried, the contracts <br />were approved. <br />HOMELAND .SANITARY SEWED. #2 - ASSESSMENT ROLL #2979 APPROVED <br />IN ENTIRETY <br />The following recommendation by Mr. Farrand was read by the Board: <br />At the time of the public hearing on the above referenced <br />Assessment Roll, the Assessment.Roll was approved with two <br />exceptions.. These exceptions were made to provide time to <br />evaluate the effect and legality of this Assessment Roll <br />on property owned by Mr. Donald Galbreath and Mr. George <br />Radman. <br />The City Attorney's Office, in cooperation with the Depart- <br />ment of Public Works, has reviewed the legal implications <br />of assessment against the Galbreath property, and the <br />consideration of the fact that Mr. Galbreath had been paying <br />a sewer charge and is indirectly hooked into the city system. <br />It has been determined that this is a private sewer line to <br />Q serve another property into which Mr. Galbreath has tapped. <br />Ile has, in fact, been receiving a service for the charges <br />v which had been assessed against him. Because this is a <br />private sewer tap into which he is hooked, it does not <br />exclude him from assessment for a city sewer., A copy of <br />the opinion from Ms. Georgia C. Luks of the Attorney's <br />Office is attached for your information. <br />Mr. Radman was given time to investigate appraised values <br />for his lots to determine if the assessment exceeded the <br />value of the lots. Mr. Radman was notified at the public <br />hearing that he would be given two weeks to complete this <br />investigation. .Three weeks have now elapsed since the <br />public hearing, and Mr. Radman has not reported back to <br />the Board. <br />Unless Mr. Radman does appear at the September 27 meeting <br />of the Board with information which would suggest some . <br />differing action, it is my recommendation that the Assess- <br />ment Roll be approved in its entirety and the exceptions <br />terminated. <br />s/ Rollin E. Farrand, P.E. <br />Director <br />Upon motion made by Mr. Brunner, seconded by Mr. Mullen and carried, <br />the Board accepted the recommendation of Mr. Farrand and approved <br />the Assessment Poll in its entirety and the exceptions terminated. <br />PHILLIPA STREET SANITARY SEWER - PRELIMINARY PLANS, PRELIMINARY <br />ASSESS14ENT ROLL AND ENGINEER'S ESTI14ATE FILED <br />The Bureau of Design & Administration submitted to the---Board--the'pre— <br />liminary plans, preliminary assessment roll and the engineer's <br />estimate of $99,247.34 for the sanitary sewers for Phillipa Street, <br />Hillside Avenue and Highland Avenue, authorized under Improvement <br />Resolution No. 3433, 1976. Upon motion made by Mr. Mullen, seconded <br />by Mr. Brunner and carried, the Board filed the preliminary plans, <br />preliminary assessment roll and engineer's estimate for the Phillipa <br />Street Sanitary Sewer. and set a public hearing for this project on <br />Monday, October 11, 1976 at 9:30 a.m. in the Board of Public Works <br />Hearing Room. <br />
