S. 31 <br />Lakeville, Indiana <br />Bid - $113,200.00 <br />Bich was signed by Richard Haskins, <br />non -collusion affidavit was in order, <br />and a 5% bid bond accompanied the bid.. <br />Upon motion made, seconded and carried, the bids were referred to <br />the Bureau of Design and Administration for review and recommendation. <br />PUBLIC HEARING - VACATION RESOLUTION NO. 3421, 1975 <br />This being the date set, hearing was held on Vacation Resolution No. <br />3421, 1975 for the vacation of Iowa Street from the south right-of-way <br />line of Prast Boulevard to the north right-of-way line of Westmoor <br />Street and Kentucky Street from the south right-of-way line of Prast <br />Boulevard to the north right-of-way line of Westmoor Street. The Clerk <br />tendered proofs of publication of notice in the South Bend Tribune and <br />the Tri-County News which were found to be sufficient. The petitioner <br />is the Bendix Corporation, Mr. James Wicks, Plant Engineer for Energy <br />Controls, was present and said the South Shore Railroad is now vacating <br />their right-of-way on these streets and the Bendix Corporation is <br />petitioning for the vacation to provide parking facilities for their <br />employees. Mr. Charles Mulrenen of the Chicago -South Shore and South <br />Bend Railroad was present and said the South Shore supports the <br />vacation. There were no remonstrators present and no written <br />remonstrances were filed with the Board. Upon motion made, seconded <br />and carried, the Board confirmed Vacation Resolution No. 3421 and said <br />portions of Iowa Street and Kentucky Street are vacated. The City <br />Engineer is directed to prepare an Assessment Roll showing the award <br />of damages and the assessment of benefits to the surrounding <br />properties. <br />VACATION RESOLUTION NO. 3422, 1975 RESCINDED AND VACATION DENIED <br />This being the date set, hearing was held on Vacation Resolution <br />No. 3422, 1975 for the vacation of the east -west alley running between <br />Lots 6 and 7 in City View Place from Kemble Avenue on the west to the <br />first north -south alley between Donald and Calvert Streets on the east. <br />The Clerk tendered proofs of publication of notice in the South Bend <br />Tribune and the Tri-County News which were found to be sufficient. The <br />petitioner, Gene Minnick of 1922 Kemble, was present. Mr. Minnick said <br />the alley is a nuisance and causes dirt in the neighborhood. He said <br />he and Mr. Antalavits, the property owner across the alley, are the <br />only ones who clean the alley. Mr. Louis Vida, 2005 S. Catalpa, <br />was present and said he opposes the closing of the alley. He said he <br />uses the alley and in the winter it is his only access.- Mr. Vida also <br />submitted a petition to the Board signed by 20 property owners <br />asking that the alley remain open. Mr. Vida said a petition was <br />filed some years ago to close this alley and he remonstrated at that <br />time. Mr.'Lee Lidow informed the Board that he owns a building at <br />19112 Catalpa and that he is also opposed to the closing as he uses <br />the alley. Mr. Farrand read the action of the Area Plan Commission <br />at their public hearing on this matter at which time they recommended <br />the petition unfavorably to the Board. Upon motion made, seconded <br />and carried, the Board denied the vacation petition and Vacation <br />Resolution No. 3422, 1975 was rescinded. Mr. Minnick asked that the <br />matter be tabled until he consulted with an attorney. Mr. Farrand <br />advised Mr. Minnick that the Board had acted on the matter but they <br />would review and proposal that Mr. Minnick or his Attorney wished to <br />present to them. Mr. Vida then asked the Board whether a property <br />owner could install a cement post in the alley right-of-way. He <br />said a post has been installed at the corner of the alley and it is <br />difficult for vehicles to turn into the alley. Mr. Farrand said he <br />would have the matter investigated. <br />
