REGULAR MEETING <br />SEPTEMBER 29, 1975 <br />on the matter until she had time to study the information and make <br />a request to the Board. Miss Sowles was given copies of the <br />docuements concerning the matter and the Board set Monday, October <br />13 as the date for a continuation of the hearing. Miss Sowles <br />advised the Board that this date was acceptable to her. The <br />Board also directed that copies of all information relating to the <br />denial be referred to Kathleen Cekanski, Deputy City Attorney, for <br />her review. <br />HEARING ON DENIAL OF TAXI CAB LICENSE HERMAN OWENS, JR. <br />Mr. Herman Owens, Jr. was present and asked the Board to reconsider <br />the matter of his taxi license application which was denied. <br />Mr. Owens said he would like to get the license so that he can earn <br />a living. He said he is undergoing treatment for alcoholism and has <br />not had a drink for over a year. He said the charges listed against <br />him all occurred before 1970. Mr. Owens was asked if he has a <br />valid driver's license at this time and he produced his valid <br />chauffeur's license for the Board. The Board asked Mr. Owens if he <br />would get a letter from the doctor who is treating him now and bring <br />it to them. Mr. Owens said he would do this. The Board took the <br />matter under advisement until Monday, October 6 at which time they. <br />will review the letter from Mr. Owens' doctor and reconsider the <br />matter. All documents in reference to the matter were referred to <br />Deputy City Attorney Kathleen Cekanski for her review. <br />r-I RECOMMENDATION FILED RE: PETITION TO VACATE NORTH -SOUTH ALLEY <br />EAST OF WALNUT STREET <br />A report was received from the Bureau of Design and Administration <br />that they had reviewed the petition to vacate the first north -south <br />alley east of Walnut Street, running north from Sample Street to <br />the south right-of-way line of the east -west alley between Fisher <br />Street and Sample Street. They have no objection to the proposed <br />vacation and there are no public utilities in the vacation area. <br />Upon motion made, seconded and carried, the report was filed and <br />the petition was referred to the Area Plan Commission for review and <br />recommendation. <br />LETTER FROM CLYDE WILLIAMS RE: AIRPORT INDUSTRIAL PARK FILED <br />The Board received the following letter: <br />"Board of Public Works <br />City of South Bend <br />Gentlemen: <br />Re: Airport Industrial Park <br />Phase III, EDA Project <br />No. 06-01-00999 <br />Enclosed is a copy of a letter from Woodruff and Sons, Inc., <br />in which they promise to complete the long overdue railroad <br />track work by October 1, 1975. On September 5, 1975, I had <br />notified them that I would recommend termination of their <br />contract due to default if the track work was not started <br />by September 10, 1975. <br />Unless Woodruff and Sons, Inc. has completed all railroad <br />track construction by October 1, 1975 and has submitted an <br />acceptable, written schedule for completion of the electrical <br />power system and railroad crossing signals, we will <br />recommend that you give them written notice of default and <br />termination of the contract in accordance with Section 108.08 <br />of the contract specifications. <br />Very truly yours, <br />s / Gerald R.
