REGULAR MEETING SEPTEMBER 29, 1975 on the matter until she had time to study the information and make a request to the Board. Miss Sowles was given copies of the docuements concerning the matter and the Board set Monday, October 13 as the date for a continuation of the hearing. Miss Sowles advised the Board that this date was acceptable to her. The Board also directed that copies of all information relating to the denial be referred to Kathleen Cekanski, Deputy City Attorney, for her review. HEARING ON DENIAL OF TAXI CAB LICENSE HERMAN OWENS, JR. Mr. Herman Owens, Jr. was present and asked the Board to reconsider the matter of his taxi license application which was denied. Mr. Owens said he would like to get the license so that he can earn a living. He said he is undergoing treatment for alcoholism and has not had a drink for over a year. He said the charges listed against him all occurred before 1970. Mr. Owens was asked if he has a valid driver's license at this time and he produced his valid chauffeur's license for the Board. The Board asked Mr. Owens if he would get a letter from the doctor who is treating him now and bring it to them. Mr. Owens said he would do this. The Board took the matter under advisement until Monday, October 6 at which time they. will review the letter from Mr. Owens' doctor and reconsider the matter. All documents in reference to the matter were referred to Deputy City Attorney Kathleen Cekanski for her review. r-I RECOMMENDATION FILED RE: PETITION TO VACATE NORTH -SOUTH ALLEY EAST OF WALNUT STREET A report was received from the Bureau of Design and Administration that they had reviewed the petition to vacate the first north -south alley east of Walnut Street, running north from Sample Street to the south right-of-way line of the east -west alley between Fisher Street and Sample Street. They have no objection to the proposed vacation and there are no public utilities in the vacation area. Upon motion made, seconded and carried, the report was filed and the petition was referred to the Area Plan Commission for review and recommendation. LETTER FROM CLYDE WILLIAMS RE: AIRPORT INDUSTRIAL PARK FILED The Board received the following letter: "Board of Public Works City of South Bend Gentlemen: Re: Airport Industrial Park Phase III, EDA Project No. 06-01-00999 Enclosed is a copy of a letter from Woodruff and Sons, Inc., in which they promise to complete the long overdue railroad track work by October 1, 1975. On September 5, 1975, I had notified them that I would recommend termination of their contract due to default if the track work was not started by September 10, 1975. Unless Woodruff and Sons, Inc. has completed all railroad track construction by October 1, 1975 and has submitted an acceptable, written schedule for completion of the electrical power system and railroad crossing signals, we will recommend that you give them written notice of default and termination of the contract in accordance with Section 108.08 of the contract specifications.
