0 <br />REGULAR MEETING SEPTEMBER'29, 1975 <br />Tribune and the Tri-County News which -were found to be sufficient. <br />Mr. Farrand explained that this resolution was initiated upon the <br />petition of property owners in the area and that this was a standard <br />Barrett Law project whereby the City participates to the extent of <br />50% of the cost. Mr. Farrand said the engineering work was done by <br />the City. A preliminary assessment roll showing amounts to be assessed <br />against property owners was available for inspection, as were preliminary <br />plans for theproject. Mr. Farrand noted that the assessment does not <br />include a hook up from the property line to the house, which is the <br />responsibility of the property owner. Mr. Farrand said the assessment <br />roll was available for inspection and said the Board would be glad to <br />answer any questions. Mr. Harley Powell, 5434 Miami Road, asked about <br />a fence which.had been constructed on the easement behind his <br />property and whether it would have to be removed. Mr. Farrand said this <br />is a matter for the property owner to determine. He said the fence <br />could be removed and replaced after construction of the sewer by the <br />property owner. He said if the property owner is willing to give the <br />City an easement for the sewer construction so that the fence does not <br />have to be moved, the City would also consider that. Mr. Andrew <br />Krizman, 5434 Raleigh Drive, asked how soon the sewer construction could <br />be started. He said his septic system is overflowing and they need <br />the sewer. Mr. Farrand said the City could expect to let a contract for <br />construction in about 30 days and construction could go on during the <br />winter months. Mrs. Glod, 5601 Abshire Drive, asked if it was up to <br />the contractor when work would begin. Mr. Farrand said the City would <br />specify the date work should begin. Pars. Fay Walters, 5402 Miami St., <br />said many septic systems are failing in the area and the property owners <br />would have to consider new systems if the sewers are not constructed. <br />Mr. Farrand said he would not recommend that anyone go into a new <br />septic system at this time. Mr. Barcome asked whether those property <br />owners present were all in favor of the sewers and there was general <br />agreement that they were. Therewere no further questions and no one <br />present asked to speak further on the matter. Mr. Farrand then <br />advised the property owners that David Wells, Manager of the Bureau of <br />Design and Administration, would be available to speak to any of those <br />present regarding their assessments. <br />Upon motion made, seconded and carried, the Board confirmed Improvement <br />Resolution No. 3420 and the improvement is ordered to be made. <br />PUBLIC HEARING - VACATION RESOLUTION NO. 3418 <br />This being the date set, hearing was held on Vacation Resolution No. <br />3418 for the vacation of the north -south alley east of Walnut Street, <br />running south from the south right-of-way line of Fisher Street to <br />the north right-of-way line of the east -west alley between Fisher <br />Street and Sample Street. The Clerk tendered proofs of publication <br />of notice in the South Bend Tribune and the Tri-County News which <br />were found to be sufficient. Mr. William Lagodney, petitioner, was <br />present. Mr. Lagodney said he is theowner of Lot 25 and he said the <br />alley in question is only seven feet wide. Vehicles which use the alley <br />break up concrete on his property. No remonstrators appeared and no <br />written remonstrances were received. Upon motion made, seconded and <br />carried, the Board ratified and confirmed Vacation Resolution No. 3418 <br />and said alley is vacated. <br />The City Engineer is directed to prepare an Assessment Roll showing <br />the award of damages and the assessment of benefits to the surrounding <br />properties. <br />HEARING ON DENIAL OF TAXI CAB LICENSE - DONALD M. RILEY <br />Marcia Sowles, of the Legal Aid Society, was present with Donald M. Riley. <br />Mr. Riley's application for a taxi cab license was denied upon the <br />recommendation of Chief John H. Walsh, Bureau of Police. Miss Sowles <br />asked the Board for copies of the report of the Police Department and <br />all other pertinent documents relating to the denial of Mr. Riley's <br />application. She then asked the Board to defer any further action <br />
