1 REGULAR MEETING SEPTEMBER 2, 1975 VACATION RESOLUTION NO. 3418 RESOLVED BY THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND, INDIANA, That it is desirable to vacate the following: The north -south alley east of Walnut Street, running south from the south right-of-way line of Fisher Street to the north right -of --way line of the east -west alley between Fisher Street and Sample Street Reserving the rights and easements of all Utilities and the Municipal City of South Bend, Indiana, to construct and maintain any facilities, including, but not limited to, the following: electric, telephone, gas, water, sewer, surface water control structures and ditches, within the vacated right of way, unless such rights are released by the individual Utilities. The following property may be injuriously or beneficially affected by such vacation: Lot Number 15, 16, 17 and 25 Notice of this Resolution shall be published on the 5th and 12th day of September, 1975 in the South Bend Tribune and in the Tri-County News. This Board at its office, on the 29th day of September, 1975 at 9:30 a.m. will hear and receive remonstrances from all persons interested in or affected by these proceedings. WALZ TENT SALE APPROVED The Board received a request from J. E. Walz, Inc. to hold their annual tent sale in the 3400 block of South Main Street from September 8th through the end of the month. A recommendation was received from the Bureau of Traffic and Lighting that the request could be approved with the stipulation that any lighting or advertising be directed in such a way that motorists on slain Street will not be blinded. A recommendation was also received from the Bureau of Buildings and Permits that the installation had been reviewed and could be approved, subject to complying with all regulations of the Fire Prevention Bureau and the Bureau of Buildings. Upon motion made by Mr. Farrand, seconded by Mr. Seitz, and carried, the tent sale was approved subject to the stipulations of the Bureau of Traffic and Lighting and the Bureau of Buildings and Permits. LETTER RECEIVED REGARDING CURBS AND SIDEWALKS IN NORTHWEST AREA A letter was received from John Hipskind, 1063 Woodward Avenue, calling the attention of the Board to the deteriorated condition of sidewalks and curbs in the northwest section of the City. The letter specified boundaries and asked that the City investigate the matter and enforce existing ordinances regarding sidewalk and curb maintenance. Upon motion made, seconded and carried, the Board took the matter under advisement and it was referred to Mr. Farrand for review. The poard's attention was particularly called to the lack of sidewalks on Riverside Drive, adjacent to the Leeper Park tennis courts.
