1 <br />REGULAR MEETING SEPTEMBER 2, 1975 <br />VACATION RESOLUTION NO. 3418 <br />RESOLVED BY THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND, <br />INDIANA, That it is desirable to vacate the following: <br />The north -south alley east of Walnut Street, running <br />south from the south right-of-way line of Fisher Street <br />to the north right -of --way line of the east -west alley <br />between Fisher Street and Sample Street <br />Reserving the rights and easements of all Utilities and the Municipal <br />City of South Bend, Indiana, to construct and maintain any facilities, <br />including, but not limited to, the following: electric, telephone, <br />gas, water, sewer, surface water control structures and ditches, within <br />the vacated right of way, unless such rights are released by the <br />individual Utilities. <br />The following property may be injuriously or beneficially affected by <br />such vacation: <br />Lot Number 15, 16, 17 and 25 <br />Notice of this Resolution shall be published on the 5th and 12th day <br />of September, 1975 in the South Bend Tribune and in the Tri-County <br />News. <br />This Board at its office, on the 29th day of September, 1975 at 9:30 a.m. <br />will hear and receive remonstrances from all persons interested in <br />or affected by these proceedings. <br />Adopted this 2nd day of September, 1975. <br />BOARD OF PUBLIC WORKS <br />s/ Rollin E. Walz, Inc. to hold their <br />annual tent sale in the 3400 block of South Main Street from <br />September 8th through the end of the month. A recommendation was <br />received from the Bureau of Traffic and Lighting that the request <br />could be approved with the stipulation that any lighting or <br />advertising be directed in such a way that motorists on slain Street <br />will not be blinded. A recommendation was also received from the <br />Bureau of Buildings and Permits that the installation had been reviewed <br />and could be approved, subject to complying with all regulations of <br />the Fire Prevention Bureau and the Bureau of Buildings. Upon <br />motion made by Mr. Farrand, seconded by Mr. Seitz, and carried, the <br />tent sale was approved subject to the stipulations of the Bureau of <br />Traffic and Lighting and the Bureau of Buildings and Permits. <br />LETTER RECEIVED REGARDING CURBS AND SIDEWALKS IN NORTHWEST AREA <br />A letter was received from John Hipskind, 1063 Woodward Avenue, <br />calling the attention of the Board to the deteriorated condition of <br />sidewalks and curbs in the northwest section of the City. The letter <br />specified boundaries and asked that the City investigate the matter <br />and enforce existing ordinances regarding sidewalk and curb maintenance. <br />Upon motion made, seconded and carried, the Board took the matter <br />under advisement and it was referred to Mr. Farrand for review. <br />The poard's attention was particularly called to the lack of sidewalks <br />on Riverside Drive, adjacent to the Leeper Park tennis courts. <br />
