REGULAR MEETING <br />JULY 18. 1977 <br />PUBLIC HEARING ON ASSESSMENT ROLL VACATION RESOLUTION NO. 3442 <br />This being the date set, hearing was held on the Assessment Poll <br />with respect to Vacation Resolution No. 3442 for the vacation of <br />Kaley Street from the south right-of-way line of Kenwood Avenue <br />to the north right-of-way line of Linden Avenue, a distance of <br />270 feet, also, the east -west alley between Kenwood Avenue and <br />Linden Avenue, running east from the east right-of-way line of <br />Kaley Street to the west right-of-way line of the north -south <br />alley between Kaley Street and Meade Street, a distance of 130 feet, <br />all in Kaley's 1st Subdivision. The Clerk tendered proofs of <br />publication of notice in the South Bend Tribune and the Tri-County <br />News which were found to be sufficient. No remonstrators appeared <br />and no written remonstrances were filed. Upon motion made by Mr. <br />McMahon, seconded by Mr. Mullen and carried, the Assessment Roll <br />showing $0.00 net damages and'$0.00 net benefits was approved and <br />said resolution is in all things ratified and confirmed and said <br />proceedings closed. <br />PETITION TO CONSTRUCT SANITARY SEWERS IN THE SOUTHWEST <br />AREA OF CREST MANOR FILED <br />The Board received a petition signed by eight property owners request- <br />ing that sanitary sewers be constructed in the southwest area of <br />Crest Manor. Upon motion made, seconded and carried, the petition <br />was filed and referred to the Bureau of Engineering to prepare".plans, <br />preliminary assessment roll and engineer's estimate. <br />LETTER FROM HAROLD MEDOW RE: SUNDAY AUTO MART <br />The Board of Public Works received the following letter: <br />"When I read that our Board of Public Works approved <br />renting the city's Colfax parking garage for $65 every <br />other Sunday to the Sunday Auto Mart of Fort Wayne, I <br />felt very much uncared for, hurt and frustrated. <br />The dealers in the Michiana area: <br />1. Have the responsibility of selling and servicing <br />motor vehicles to the people of Michiana, and <br />therefore have huge investments in facilities. <br />2. Pay hundreds of thousands of dollars in local <br />taxes on them, and must continue to spend money <br />on them to keep them up to date. <br />3. Furnish employment to large numbers of local, <br />people with payrolls amounting to millions of <br />dollars annually. <br />4. Have contributed much time and considerable monies <br />for countless local civic and community organizations. <br />5. Have entered wholeheartedly in honest, spirited bidding <br />when governmental agencies have needed such competitive <br />bidding. <br />6. (Those in the inner core area) have demonstrated <br />their loyalty to downtown South Bend (at a time <br />when it's sorely needed) by staying downtown. Many <br />other communities have seen a mass exodus from their <br />downtown districts to the fringe areas. <br />It's possible the Sunday Auto Mart is not violating the letter of <br />the Indiana law by enabling vehicles to be sold on Sunday, but the <br />spirit of the regulation is most certainly violated. Moreover, <br />the citizens of Michiana are much better served by allowing local <br />dealers to handle vehicle sales because of the consequent necessary <br />service. <br />
