REGULAR MEETING <br />JULY 11, 1977 <br />Eisenhour Construction Co. - Bid,was.signed by Patterson N. Rider, <br />East Lansing, Michigan non -collusion affidavit was in order <br />and a 5% bid bond was submitted. <br />bid - $53,060.00 <br />American Asphalt Paving Company Bid was signed by Charles E. Kelly, <br />Chicago, Illinois non -collusion affidavit was in order <br />and a certified check in the amount <br />- of $5,000 was submitted. <br />Bid - $92,402.00 <br />Asphalt Milling Wirtgen Co. Bid was signed by R. Wirtgen, <br />Ridgefield, New Jersey non -collusion affidavit was in order <br />and a 5% bid bond was submitted. <br />Bid - $75,465.00 <br />Tom Robinson & Son, Inc. Bid was signed by Walter Pope, <br />Jackson, Michigan non -collusion affidavit was in order <br />and a 5% bid bond was submitted. <br />Bid - $60,547.50 <br />Upon motion made by Mr. Mullen, seconded by Mr. Brunner and carried, <br />the bids were referred to the Bureau of Engineering and Bureau of <br />Streets for review and recommendation. <br />HOUSE MOVE TO 820 W. COLFAX APPROVED CONDITIONALLY <br />John DeLee, Building Commissioner, submitted to the Board an <br />application from Lee Barnhart to move a house from 314 W. Marion <br />Street to 820 W. Colfax. Attached to the application were utility <br />clearances. Notices were sent to the property owners in the <br />area where the house is to be moved and a public hearing on the <br />house move was now held. There was no one present who wished to <br />speak on the matter. Ralph J. Wadzinski, Manager of the Bureau of <br />Traffic and Lighting, submitted to the Board a copy of a letter from <br />the Indiana State Highway Commission indicating that they would <br />approve the portion of the move on U. S. 20, with the stipulation <br />that the move not be made on a Saturday, Sunday or holiday or on a <br />day before or a day after a holiday. Mr. Wadzinski also noted that <br />he has received confirmation that a pre -qualified signal contractor <br />has been hired to do the necessary traffic signal work connected with <br />the move. Mr. Wadzinski recommended that the house move be approved <br />with the stipulation that the date and the time of day be determined <br />at the discretion of Mr. Wadzinski and Captain James Sweitzer of the <br />Police Department Traffic Detail. Mr. Barnhart was present and said <br />he was asking for approval of this route at this time but would then <br />pursue an amendment to the Ordinance through the Common Council to <br />allow the move on Lafayette Street to Colfax. Mr. Brunner noted that <br />he had discussed this procedure with Mr. Barnhart and has advised <br />him that the Legal Department would be willing to help him with the <br />language of the proposed ordinance amendment. It is the opinion of <br />the Legal Department that they cannot approve the route using Lafayette <br />Boulevard to Colfax, since the language of the ordinance is specific <br />in prohibiting such use. This Board does not have the authority <br />to approve a route in violation of the Municipal Code. Mr. Barnhart <br />said he would like to get an amendment to the Code, since to use the <br />route the -Board is considering today would cost him $1100 for utility <br />and signal work. He said he has an agreement with Temple Beth -El to <br />remove the house within a stipulated time and some action must be <br />taken immediately. Mr. Brunner said the Board is sympathetic to <br />Mr. Barnhart's problem and would have no objection to an amendment to <br />the ordinance which would provide a narrow exception to the language <br />as it now stands. Mr. Mullen made a motion that the Board approve <br />the house move to 820 W. Colfax Avenue, using the following route: <br />1 <br />
