<br />ESOLUTION NO. 3414, 1977
<br />Upon motion made by Mrl. McMahon, seconded by Mr. Mullen and carried,
<br />the following resolution was adopted in conjunction with the petition
<br />of the Schafer Gear Works to vacate two alleys:
<br />VACATION RESOLUTION NO. 3444. 1977
<br />RESOLVED BY THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND,
<br />INDIANA, That it is desirable to vacate the following:
<br />The north -south alley south of Tutt Street to the east -
<br />west alley directly south, and including the aforesaid
<br />east -west alley from Main Street to the adjacent alley,
<br />City of South Bend.
<br />Reserving the rights and easements of all Utilities and the Municipal
<br />City of South Bend, Indiana, to construct and maintain any facilities,
<br />including, but not limited to, the following: elec-tric, telephone,
<br />gas, water, sewer, surface water control structures and ditches, within
<br />the vacated right-of-way, unless such rights are released by the
<br />individual Utilities.
<br />The following property may be injuriously or beneficially affected
<br />by such vacation:
<br />Lot Numbers 211, 212, 213, 214, 215, 216, 217, 218, 219 and 220
<br />in Daniel Garst's 1st Addition. Lot Numbers 259 and 260 in
<br />Daniel Garst's Subdivision of Part of Garsts 1st Addition.
<br />Notice of this resolution shall be published on the 8th and 15th
<br />days of July, 1977 in the South Bend Tribune and the Tri-County
<br />News. This Board, at its office, on the 25th day of July, 1977
<br />at 9:30 o'clock, A.M., will hear and receive remonstrances from all
<br />persons interested in or affected by these proceedings.
