REGULAR MEETING MAY 31, 1977 <br />Reserving the rights and easements of all Utilities and the Municipal City of <br />South Bend, Indiana, to construct and maintain any facilities, including, but <br />not limited to, the following: electric, telephone, gas, water, sewer, <br />surface water control structures and ditches, within the vacated right of way <br />unless such rights are released by the Individual Utilities. <br />The following property may be injuriously or beneficially affected by such <br />vacation: <br />Lot Numbers 30 through 36 and 69 through 75 in Kaley's 1st Subdivision. <br />Notice of this Resolution shall be published on the 3rd and loth day of June, <br />1977 in the South Bend Tribune and in the Tri-County News. This Board at <br />its office, on the 20th day of June, 1977 at 9:30 o'clock A.M., will hear <br />and receive remonstrances from all persons interested in or affected by these <br />proceedings. <br />Adopted the 31st day of May, 1977. <br />BOARD OF PUBLIC WORKS <br />s/ Patrick M. Mullen <br />Attest; <br />s/ Patricia DeClercq,,Clerk <br />BID AWARDED - JOHNSON STREET SANITARY AND STORM SEWER CONSTRUCTION <br />The Board received a recommendation from the Department of Public Works <br />that, after a review of all bids received for the Johnson Street Sanitary and <br />Storm Sewer project, the low bid of H. DeWulf Mechanical Contractor, Inc. <br />should be accepted. A bid tabulation was attached to the recommendation. <br />Upon motion made by Mr: McMahon, seconded by Mr. Mullen and carried, the <br />Board accepted the low bid of H. DeWulf Mechanical Contractor, Inc. of <br />$229,491.70 for the construction of the Johnson Street sewer project. <br />FILING OF ASSESSMENT ROLL - VACATION RESOLUTION NO. 3440 <br />Patrick M. McMahon, Civil City Engineer, files an Assessment Roll for <br />Vacation Resolution NO. 3440 for the vacation of the second east -west alley <br />south of LIncolnway West, running from the east right-of-way line of Olive <br />Street east 125 feet to the west right-of-way line of the north -south alley <br />east of Olive Street in Jacob Miller's Addition. The following property may <br />be injuriously or beneficially affected by such vacation: Lot numbers 3 <br />through 10 and 14 through 19 in Jacob Miller's Addition. The Board finds that <br />each of said lots have been benefited in the amount of $0.00 and damaged in <br />the amount of $0.00. Upon motion made by Mr. McMahon, seconded by Mr. Brunner <br />and carried, the Assessment Roll was filed and set for public hearing on <br />June 20, 1977. <br />REPORT FILED -PETITION OF SCHAFER GEAR WORKS TO VACATE THREE ALLEYS <br />The Board received a report from the Bureau of Design and.Administration that <br />the petition of the Schafer Gear Works had been reviewed and they have no <br />objection to the vacation, subject to existing utility easements. Attached <br />to the recommendation was a report from the Fire Department indicating that <br />they had no objection to the vacation, providing an access gate is installed <br />at the alley intersection on Tutt Street east of Main Street. A drawing <br />was attached indicating the location of the access gate. The Northern Indiana <br />Public Service Company submitted a Notice of Public Utility Use regarding <br />the alley where a 4" gas main is located and indicated they did not waive <br />their rights in the alley. Upon motion made by Mr. McMahon, seconded by <br />Mr. Brunner and carried, the report and correspondence were filed and made a <br />part of the record of proceedings in this vacation petition and the petition <br />was referred to the Area Plan Commission for their review and recommendation. <br />
