to"'-f � <br />GULAR TEETING <br />FEBRUARY 14, 1977 <br />"Gentlemen: <br />For some time, this department has been negotiating <br />with various municipalities in Michigan in regard <br />to treating their sewage. Briefly, the proposition is: <br />1. Sewage to be delivered to the close proximity of <br />the South Bend Waste Water Treatment Plant. <br />?. Installation, operation and maintenance of the <br />delivery system to be completely borne by the <br />municipalities in Michigan. <br />3. Treatment charges to be based on current South Bend <br />rates plus a 50% surcharge. <br />4. Since our rates include a provision for maintenance <br />of the collection s,Tstem, the possibility of a <br />discount was mentioned but neither a figure exists <br />nor does the decision.to come to South Bend Waste <br />Water Treatment Plant turn on this discount. <br />It is my considered judgment that this proposal is in the <br />best interests of the City and would therefore request <br />your favorable action on this resolution which expresses <br />only the current intent of the City. <br />Very truly yours, <br />s/ David A. jells, P. E. <br />Attached to the letter was the attached proposed resolution: <br />RESOLIJTIO14 110. 4, 1977 <br />WHEREAS, the consulting firms making the facilities plan <br />studies for the Village of Edwardsburg and the <br />Townships of Ontwa, Hason, Calvin and Jefferson <br />in Cass County, Michigan have requested that the <br />City of South Bend consider taking sanitary <br />sewage from the Village of Edwardsburg and the <br />Townships of Ontwa, Mason, Calvin and Jefferson <br />into the City of South Bend's Wastewater Treatment <br />Plant for treatment; and <br />WHEREAS, the City of. South Bend's Wastewater Treatment Plant <br />has capacity to take the added loading; and <br />WHEREAS, there will be a possibility for lower treatment rates <br />for all customers of the South Bend Wastewater <br />Treatment Plant with the addition of new customers: <br />NOW, THEREFORE, BE IT P.ESOLVED that the Board of Public Works <br />of the City of South Bend is receptive to the concept <br />of providing seTv7age treatment for the Village of <br />Edwardsburg and the Townships of Ontwa, Mason, Calvin <br />and Jefferson in Cass County, Michigan. <br />Mr. Brunner asked whether there had been any research regarding <br />any legal ramifications of such a plan for a sewage agreement <br />between two states. Mr. David Wells, Manager of the Bureau of <br />Design and Administration, said there is legislation to allow this <br />and precedent has been set in Indiana where Michigan City and a <br />Michigan community have entered into such a project. Mr. Wells <br />noted that this resolution cones at the request of Williams and <br />Works Engineers of Grand Rapids, Michigan and noted that a letter <br />
