Fuell. It was noted
that on September 13, 1982, the Board had denied a license
application for the premises because video games were found on
the premises and the use of said games was not permitted under
the Secondhand Dealer's License and was, in addition, a violation
of the controlled use section of the Municipal Code. Mr.
Leszczynski stated that the facility was properly zoned for the
operation of a secondhand business; adequate off-street parking
was provided; and no fire code violations were found on the
premises. He also stated that, subsequent to the denial. of the
first application, the video games had been removed from 1404
South Michigan and only one game remained at 1406 South Michigan.
Mr. Fuell was present at the Board meeting, and advised that he
had been under the impression that he could operate such games
because the 7-Eleven Stores were doing so. He advised that he
had since removed the games except for one video game which would
be located at 1406 South Michigan, and a closed door separated
the two rooms. It was noted that, according to the Municipal
Code, an amusement arcade constituted a controlled use violation
and an arcade was defined as having two or more games for operation.
Upon a motion made by Mr. Hill, seconded by Mr. Leszczynski and
carried, the Secondhand Dealer's License application for Mr.
Fuell was approved and referred to the Deputy Controller's Office
for issuance.
FILE ENVIR014MENTAL CLEA14-UP OF LOTS
A list containing 81 lots ordered cleaned by the Director of the
Neighborhood Code Enforcement Office was submitted.
