Purvis, <br />2300 Sterling Ave. non -collusion affidavit was in order, <br />Elkhart, Indiana 46516 and a 5% bid bond was submitted. <br />Built -Up Roof $25,543.00 <br />Alternate No. 1 - Single -Ply System 24,890.00 <br />Upon a motion made by Mr. Leszczynski, seconded by Mr. Hill and carried, <br />the above bids were referred to the Fire Department for review and <br />recommendation. <br />OPENING OF BIDS - LEASE OF PORTION OF ALLEN'S ALLEY <br />This was the date set for receiving sealed bids for the lease of a <br />portion of Allen's Alley. The Clerk tendered proofs of publication <br />of notice in the South Bend Tribune and the Tri-County News which <br />were found to be sufficient. The following bid was opened and <br />publicly read: <br />Edmarde's Inc., d/b/a Senor Kelly's $1,550.00 per year <br />119 North Michigan Street <br />South Bend, Indiana 46601 <br />Mr. Leszczynski noted that the city's offering price for lease of <br />the 17.5' x 110' portion of Allen's Alley extending from Woodward <br />Court east to Michigan Street was $1,550.00 annually based on an <br />appraisal of the property. Among the specifications for lease of <br />the public right-of-way were the stipulations that the real estate <br />be used for commercial purposes only; any fencing to be erected <br />must be approved by the Board of Public Works and must be removed <br />by Lessee at end of lease period; that the entire eastern half of <br />the alley be maintained by Lessee; that adequate liability insurance <br />for the property be provided; and that the term of the lease shall <br />be for a period of three years with a provision for termination <br />upon 90 days' written notice by either party. Mr. Leszczynski <br />advised that the bid of Edmarde's Inc. incorporated the above <br />bid conditions and requested that, if the bid was accepted, the <br />Lessee be given two consecutive options to renew the lease at the <br />aforementioned amount, the first renewal option to expire on June <br />30, 1987, and the second renewal option to expire on June 30, 1992. <br />Further, in order to exercise any renewal option, the Lessee <br />provide written notice to the City of South Bend at least 30 days <br />prior to the end of the base term of the lease and prior to the <br />end of the first renewal option period. Upon a motion made by <br />Mr. Hill, seconded by Mr. Leszczynski and carried, the bid of <br />Edmarde's Inc. was referred to the Legal Department for review <br />and recommendation. <br />j <br />1 <br />
