341 <br />REGULAR MEETING IDULY 12,'1982 <br />Building Department and the Bureau of Traffic and Lighting had <br />no objections to the proposed house move, provided that a <br />pre -qualified signal contractor perform all signal work <br />necessary. It was further noted that all adjacent property <br />owners had been notified of the move and no one was present <br />to speak against the house move. Upon a motion made by Mr. <br />Leszczynski, seconded by Mr. Hill and carried, the public <br />hearing was closed. Upon a motion made by Mr. Leszczynski, <br />seconded by Mr. Kernan and carried, the house move Ias proposed <br />was approved, subject to the filing of a letter of confirmation <br />from a pre -qualified signal contractor. <br />PUBLIC HEARING - APPROVE VACATION OF EAST -WEST <br />ALLEY IN CITY VIEW PLACE ADDITION <br />Mr. Leszczynski advised that the petitioners in the matter of <br />the proposed vacation of the first east -west alley north of <br />Ewing Avenue running west from Catalpa Street to the first <br />north -south alley for a distance of 140 feet, all being in <br />(` City View Place Addition, were James and Louise Balint, <br />residents and owners of property at 2205 Catalpa Avenue and <br />abutting property owners to the alley in question. He stated <br />that, as in the past, in order for the Board to submit a recom- <br />mendation to the Common Council, a public hearing had been <br />scheduled at this time and all property owners within 200 <br />feet of the alley had been duly notified. He further advised <br />that favorable comments in support of the vacation had been <br />received from the Engineering Department, Area Plan Commission <br />and Community Development Department. Mr. Leszczynski stated <br />that a letter had been received by the Board from Mr. Theodore <br />Reiter, 2210 S. Catalpa Street, concerning his fear that the <br />closing of the above alley would eventually mean the closing <br />of the alley next to his home. It was noted, however, that <br />the closing of the above alley had no direct bearing on the <br />alley adjacent to Mr. Reiter's property. Upon a motion made <br />by Mr. Leszczynski, seconded by Mr. Kernan and carried, the <br />public hearing was officially closed. Upon a motion made by <br />Mr. Hill, seconded by Mr. Kernan and carried, a favorable <br />recommendation for the vacation of the above alley was forwarded <br />to the Common Council, subject to the maintenance of all utility <br />easements. <br />PUBLIC HEARING - APPROVE VACATION OF EAST -WEST <br />ALLEY IN SOUTH BEND CITY ADDITION <br />It was noted that Mr. James G. Wood, 50655 Linden Grove Lane, <br />Granger, Indiana, and owner of adjacent property to the above <br />alley in question, was petitioning the Common Council for the <br />vacation of the first east -west alley south of Garst Street <br />running west from Lafayette Street to a line 6 feet east of <br />and parallel to the north -south alley for a distance of 159 <br />feet and being abutted by Lots 64 and 65 of South Bend City <br />Addition. Mr. Leszczynski stated that, as in the past, in <br />order for the Board to submit a recommendation to the Common <br />Council, a public hearing had been scheduled at this time <br />and all property owners within 200 feet of the alley had been <br />.duly notified. He further advised that favorable comments in <br />support of the vacation had been received from the Engineering <br />Department, Area Plan Commission and Community Development <br />Department, provided two 6' x 20' parcels are dedicated to <br />the city for turning north and south from the east -west remain- <br />ing one-half of the alley. Mr. Leszczynski noted that a Quit- <br />claim Deed executed by Mr. Wood conveying the required property <br />for right-of-way purposes had been submitted. Upon a motion <br />made by Mr. Leszczynski, seconded by Mr. Hill and carried, the <br />public hearing was officially closed. 'Upon a motion made by <br />Mr. Leszczynski, seconded by Mr. Hill and carried, a favorable <br />recommendation for the vacation of the above alley was forwarded <br />to the Common Council, subject to the maintenance of all utility <br />easements and the necessary right-of-way already dedicated for <br />turning movements. <br />
